Land and Buildings. The list of the Land and Buildings set out in Schedule C accurately reflects all interests of the Vendor in real property used in the conduct of the Business. The Vendor represents that all agreements with respect to the Vendor's interest in the Land and Buildings are in force and effect and without amendment thereto and the interests in the Land and Buildings are free and clear of all Encumbrances. To the best of the knowledge of the Vendor and Ayres, neither asbestos nor urea formaldehyde foam is now used, or present, in any of the buildings listed in Schedule C;
Land and Buildings. 6.1. The Council agrees that it will, during the Term, allow the Commissioner and the RFS to occupy and use the Premises (being the land and buildings or parts of land and buildings specified in Schedule 1), or such other land and buildings as may be agreed upon in writing between the Council and the Commissioner, on the following terms and conditions:

Land and Buildings. Westar has a number of freehold properties in various centres located throughout Victoria. The major gas sites are Ardeer, Geelong, Ballarat, Bendigo and Warnambool. These centres are shown in Schedule 3, and are used for offices, depots, LPG plant, storage, workshops and vehicle garaging, as well as for distribution system infrastructure such as meters, regulators and city gates.
Land and Buildings. Operator hereby certifies that it shall establish a lease agreement with the FBO or other Airport lessor as mutually agreed for timely non-exclusive access to sufficient hangar space to accommodate at least one aircraft being worked on and two (2) tie down positions for customer aircraft awaiting repair or pick up and a paved area for employee and customer auto parking. Additionally, this lease agreement will provide the Operator with timely non-exclusive access to a minimum of 250 square feet of properly lighted and heated building space on Airport property for office, shop and restrooms. Such space(s) shall be accessible for Operator’s aircraft at all times during the Term(s) of this Agreement.

Furniture will be retained by the Member Groups unless it is used solely in the Member’s Current Grid Business. If the Venture elects to continue manufacturing at current locations, the Venture shall lease any land and buildings currently used by Armstrong or National in their Current Grid Businesses at a fair market value per square foot. Separate leases for each location shall be executed. If the NRM Malvern facility is used by the Venture, common items such as utilities, etc. will be allocated between NRM’s steel processing operation and the Venture on a fair basis to be agreed upon by the parties.
