IXX Project. Landlord’s obligations to perform the Work and Tenant’s obligations under this Lease are conditioned on Tenant acquiring and accepting an incentive package from the Nassau County Industrial Development Agency (the “IXX”), which package shall include, inter alia, real estate tax exemptions or reductions or frozen assessments, sales tax exemptions and mortgage tax exemptions, but shall not obligate Landlord into executing any project labor agreements for the construction of the Demised Premises (the “IXX Project”). Tenant may also seek a real estate tax PILOT Agreement as part of the IXX Project. Landlord shall cooperate with Tenant in Tenant’s endeavors to obtain the IXX Project, including, but not limited to, signing any applications and other related documents, agreeing to be a co-applicant on any application and providing any documentation in connection therewith. Moreover, Landlord and Tenant shall cooperate with each other in the structuring of the Lease to effectuate the benefits of the IXX Project. Tenant shall diligently pursue the IXX Project to obtain an inducement letter within sixty (60) days from the date of full execution of this Lease. Table of Contents

Related to IXX Project

  • Project 3.01. The Recipient declares its commitment to the objectives of the Project. To this end, the Recipient shall carry out the Project in accordance with the provisions of Article IV of the General Conditions.

  • Sub-projects 1. The Participating Bank shall make Sub-loans to Beneficiaries and appraise, review, approve, and supervise Sub-projects in accordance with the criteria, conditions and procedures set forth in the Operations Manual, including, inter alia, the following eligibility criteria:

  • Project Cost a. The estimated cost of the Project is $ 97,740.00. This amount is based upon the Schedule of Financial Assistance in Exhibit "B", attached to and incorporated in this Agreement. Exhibit “B” may be modified by mutual execution of an amendment as provided for in paragraph 5.i.

  • Project Cost Overruns In the event that the Recipient determines that the moneys granted pursuant to Section II hereof, together with the Local Subdivision Contribution, are insufficient to pay in full the costs of the Project, the Recipient may make a request for supplemental assistance to its District Committee. The Recipient must demonstrate that such funding is necessary for the completion of the Project and the cost overrun was the result of circumstances beyond the Recipient's control, that it could not have been avoided with the exercise of due care, and that such circumstances could not have been anticipated at the time of the Recipient's initial application. Should the District Committee approve such request the action shall be recorded in the District Committee's official meeting minutes and provided to the OPWC Director for the execution of an amendment to this Agreement.

  • Research Project 3.1 These Materials and Data will be used by Recipient's PI solely in connection with the Research Project, as named and described in the attached research application (insert Research Project name below):

  • Access to Project Site Redeveloper shall permit the representatives of the City to enter Project Site at any and all reasonable times, as the City may deem necessary for the purposes of this Redevelopment Agreement, including but not limited to work and inspection of all work being performed in connection with the construction of the Redeveloper Improvements. Similarly, the City shall permit Redeveloper such entry upon the public rights of way for such purposes. No compensation shall be payable nor shall any charges be made in any form by any party for the access or inspection provided for in this Section. The City’s right of access granted under this Section shall terminate upon issuance by the City of the Redeveloper’s Certificate of Completion of Redeveloper Improvements. Notwithstanding the above, Redeveloper shall not be relieved of the provisions contained in Chapter 14.29 of the Lincoln Municipal Code regarding the use of streets for private construction purposes.

  • The Project The Project is the total construction of which the Work performed under the Contract Documents may be the whole or a part.

  • Development of the Project 4.1 TSP's obligations in development of the Project: Subject to the terms and conditions of this Agreement, the TSP at its own cost and expense shall observe, comply with, perform, undertake and be responsible:

  • Project Site The “Project Site” is the place where the Work is being carried on.

  • Project Completion The Project and the Work are complete.
