Installation of Additional Equipment. Subject to the provisions of Section 3.5 hereof, the Company or any permitted sublessee of the Company from time to time may install additional machinery, equipment or other personal property in the Facility (which may be attached or affixed to the Facility), and such machinery, equipment or other personal property shall not become, or be deemed to become, a part of the Facility, so long as such additional property is properly identified by such appropriate records, including computerized records, as approved by the Agency. The Company from time to time may create or permit to be created any Lien on such machinery, equipment or other personal property. Further, the Company from time to time may remove or permit the removal of such machinery, equipment and other personal property from the Facility, provided that any such removal of such machinery, equipment or other personal property shall not occur: (i) if any Event of Default has occurred or

The Company from time to time may create or permit to be created any Lien on such machinery, equipment or other personal property. Further, the Company from time to time may remove or permit the removal of such machinery, equipment and other personal property from the Facility, provided that any such removal of such machinery, equipment or other personal property shall not occur (i) if any Event of Default has occurred; or (ii) if any such removal shall adversely affect the structural integrity of the Facility or impair the overall operating efficiency of the Facility for the purposes for which it is intended, and provided further, that if any damage is occasioned to the Facility by such removal, the Company agrees to promptly repair such damage at its own expense.

The Company from time to time may install additional furniture, fixtures, machinery, and equipment or other personal property in the Project (which may be attached or affixed to the Project), and such furniture, fixtures, machinery, and equipment or other personal property shall not become, or be deemed to become, a part of the Project. The Company from time to time may remove or permit the removal of such furniture, fixtures, machinery and equipment or other personal property; provided that any such removal of such furniture, fixtures, machinery, equipment or other personal property shall not adversely affect the structural integrity of the Project or impair the overall operating efficiency of the Project for the purposes for which it is intended and provid�d fmiher that if any damage is occasioned to the Project by such removal, the Compaii.y agrees to promptly repair such damage at its own expense.
Installation of Additional Equipment. The Borrower from time to time may install additional machinery equipment or other personal property in the Facility (which may be attached or affixed to the Facility), and such machinery, equipment or other personal property shall become, or be deemed to become, a part of the Facility unless the same is not a replacement for or substitution of Equipment as defined herein. The Borrower from time to time may, with the consent of the Issuer, which consent shall not be unreasonably withheld or delayed, remove or permit the removal of such machinery, equipment and other personal property; provided that any such removal of such machinery, equipment or other personal property shall not adversely affect the structural integrity of the Facility or impair the overall operating efficiency of the Facility for the purposes for which it is intended and that any such Lien shall not attach to any other part of the Facility and provided further that if any damage is occasioned to the Facility by such removal, the Borrower agrees to promptly repair such damage at its own expense. ARTICLE VII
Installation of Additional Equipment. The Company from time to time may install additional machinery, equipment or other personal property in the Facility (which may be attached or affixed to the Facility), and such machinery, equipment or other personal property shall not become, or be deemed to become, a part of the Facility. The Company from time to time may remove or permit the removal of such machinery, equipment or other personal property; provided that any such removal of such machinery, equipment or other personal property shall not adversely affect the structural integrity of the Facility or impair the overall operating efficiency of the Facility for the purposes for which it is intended and provided further that if any damage is occasioned to Facility by such removal, the Company agrees to promptly repair such damage at its own expense.
Installation of Additional Equipment. Subject to the provisions of Section 5.4 of this Agreement, the Borrower from time to time may, at Borrower's own expense, install additional machinery, equipment or other personal property in the Project (which may be attached or affixed to the Security Property), and such machinery, equipment or other personal property shall not become, or be deemed to become, a part of the Security Property. The Borrower shall keep appropriate records of all of such machinery, equipment or other personal property installed as Security Property sufficient to identify the same. The Borrower from time to time may remove or permit the removal of such machinery, equipment and other personal property from the Security Property and may create or permit to be created any Lien on such machinery, equipment or other personal property; provided that any such removal of such machinery, equipment or other personal property shall not adversely affect the structural integrity of the Security Property or impair the overall operating efficiency of the Security Property for the purposes for which it is intended and provided further that if any damage is occasioned to the Security Property by such removal, the Borrower agrees to promptly repair such damage at its own expense.
Installation of Additional Equipment. Notwithstanding anything to the contrary in Section 6.8, Seller may, in accordance with this Section 6.15, add additional equipment to the Facility, as it deems necessary or appropriate in its reasonable discretion, to reach (but not to exceed) its Expected Output in the first full Contract Year, unless, after such additional equipment is installed, the Maximum Delivery Rate would exceed 80,000 kW or would in any way be contrary to or otherwise violate any provision of the Seller’s Generation Interconnection Agreement for the Facility.

(a) The Company from time to time may install additional machinery, equipment or other personal property in the Project Facility (which may be attached or affixed to the Project Facility), and such machinery, equipment or other personal property shall not become, or be deemed to become, a part of the Project Facility. The Company from time to time may remove or permit the removal of such machinery, equipment or other personal property from the Project Facility; provided that any such removal of such machinery, equipment or other personal property shall not adversely affect the integrity of the Project Facility or impair the overall operating efficiency of the Project Facility for the purposes for which it is intended and provided further that, if any material damage is occasioned to the Project Facility by such removal, the Company shall promptly repair such damage at its own expense.
Installation of Additional Equipment. Subject to the provisions of Section 8.10 hereof, the Institution, or any other permitted lessees of the Institution, from time to time may install additional machinery, equipment or other personal property in the Facility (including for this purpose the presently existing improvements on the Land) (which may be attached or affixed to the Facility and/or such existing improvements), and such machinery, equipment or other personal property shall, unless the Institution otherwise elects by written notice to the Issuer and the LOC Bank, become a part of the Facility (provided that the acquisition and installation of such property is not financed from either the Project Fund or the Renewal Fund, in which case such additional items shall become a part of the Facility). The Institution, from time to time, may create or permit to be created any Lien on such machinery, equipment or other personal property. Further, the Institution, from time to time, may remove or permit the removal of such machinery, equipment and other personal property from the Facility, provided that any such removal of such machinery, equipment or other personal property shall not occur (i) if any Event of Default has occurred; or (ii) if any such removal shall adversely affect the structural integrity of the Facility or impair the overall operating efficiency of the Facility for the purposes for which it is intended, and provided further, that if any damage is occasioned to the Facility by such removal, the Institution agrees to promptly repair such damage at its own expense.
