Breeder does not provide any warranty as to the Dog’s fitness for any specific purpose, such as therapy, obedience, or working dogs, or show ring performance and/or breeding purposes. Indemnity and Release If any action or failure to act on the part of Buyer shall result in any claim, suit, loss, damage, injury death, or liability, Buyer agrees to defend, indemnify, and hold Breeder harmless and to pay all of Breeder’s costs and expenses, including reasonable legal fees, any amount paid in settlement and any award or judgment with respect thereto. Buyer releases Breeder from any and all liability, costs or damages caused by the Dog after placement with Buyer, including but not limited to damage or destruction of property, and injury to any person. Limitation of Action Any action or claim brought by Buyer against Breeder for breach of this Agreement or for loss due to negligence must be brought within one (1) year of the date such claim or loss occurs. Governing Law This Agreement shall be governed by and construed in accordance with the laws of the State of Ohio.

Fitness of Purpose. The Dog was bred as a companion animal, and Seller does not provide any warranty as to the Dog’s fitness for any specific purpose, including obedience trails, show ring performance, and /or breeding purposes. Buyer’s Representations Buyers represents to Seller that: Buyer has purchased full breeding rights at an additional fee of $________ and has the option to spay or neuter at their own discretion. The Dog Will reside with Buyer as companion pet to Buyer and Buyer’s family. Buyer will keep the Dog in an enclosed area of adequate size and will not allow the Dog to roam at will. Buyer will not keep the Dog chained or tethered or permanently house the Dog in a kennel. Buyer will provide the Dog with nutritious food and necessary veterinary care, including deworming, heartworm prevention and regular vaccinations (including rabies). Buyer is not acting as agent for any other person or business in the purchase of the Dog. Buyer will not sell, give or release the Dog to a pet shop, retail store, dog dealer, animal testing facility, research facility, or an agent for any such business or facility. In the event Buyer sells the Dog to a new owner, Buyer shall have Dog spayed or neutered prior to sale and ensure that the new owner agrees in writing to comply with the terms of the xxxx of sale/sales contract for companion Dog or Puppy without breeders right. Fitness of Purpose. That upon taking possession of Dog, that this dog is a Pet Quality dog. A “Pet Quality” Dog is defined as; a Dog determined on date of sale as free of communicable disease and free of fatal genetic defects, and possessing a temperament sound enough to act as a pet, and not that of a breeding, working, performance or conformation show dog, but that Breeder does not provide any warranty as to the Dog’s fitness for any specific purpose. Purchaser further understands and agrees that there is a risk associated with purchasing a Dog who is young, and thus still maturing for many years, and that the Breeder(s) will not be held liable nor accountable in any way if this Dog does not meet the Purchaser’s idea of Pet Quality after taking possession of Dog, neither mentally nor physically.
