Continued Employment Agreement. Should the EMPLOYER fail to have the employees sign a continued employment agreement prior to the course, the employee shall not be liable to continue his employment or reimburse the EMPLOYER for the cost of the course. An executed copy of the Schedule “A” Continued Employment Agreement shall be provided to the Local Executive and applicant.

This Agreement shall not be deemed an employment contract between the Company (or any of its subsidiaries or any other Enterprise) and Indemnitee. Indemnitee specifically acknowledges that Indemnitee’s employment with the Company (or any of its subsidiaries or any other Enterprise), if any, is at will, and Indemnitee may be discharged at any time for any reason, with or without cause, except as may be otherwise provided in any written employment contract between Indemnitee and the Company (or any of its subsidiaries or any other Enterprise), other applicable formal severance policies duly adopted by the Board, or, with respect to service as a director of the Company, by the Certificate of Incorporation, the Bylaws or the DGCL.
