Commencement and Completion Deadline for Private and Public Improvements. The Clinic Developer shall commence construction of the CBOC on the Phase A Property within thirty (30) days following receipt of a notice to proceed (“Notice to Proceed”) issued by the Urban Development Department Director. The Notice to Proceed shall only be issued upon receipt of the Clinic Developer’s request for the Notice to Proceed, certifying that all conditions precedent to commencement of the work have been completed and requesting authorization to commence the work. The conditions precedent to commencement of work include (1) proof of the Clinic Developer’s financial ability to carry out Phase A, (2) proof of a construction contract for the Phase A improvements, (3) approval of the Exterior Drawings by the City, and (4) satisfaction of the City that the Clinic Developer has provided the security required by Section 401 of the Redevelopment Agreement to the City for the Phase A Private and Public Improvements. The Clinic Developers anticipate the commencement of the Phase A Improvements within ninety (90) days following the Date of this Agreement and agree to substantially complete the same Phase A Private Improvements on or before eighteen (18) months from the date of commencement of the Redeveloper Improvements (“Completion Date”).
