City and Agency. For purposes of this Article and Article XVIII hereof, (i) the City shall not be deemed to be aggrieved by any default of the Agency and may not exercise any remedies against the Agency by reason of a default by the Agency; and (ii) the Agency shall not be deemed to be aggrieved by any default of the City and may not exercise any remedies against the City by reason of a default by the City.

City and Agency. The purpose of this ICA is to facilitate the implementation of the Redevelopment Plans and Proposition G, and development of the Project in accordance with the Redevelopment Documents and this ICA. The City and the Agency agree that: (a) the development of the Project in accordance with the Redevelopment Documents is in the best interests of the City and the health, safety and welfare of its residents, and in accord with the public purposes and provisions of applicable federal, state and local laws; (b) they intend for this ICA to provide the framework for cooperation between the City and the Agency with respect to the review and approval of Project Applications; and (c) this ICA is for their mutual benefit.

  • BROKERAGE AND AGENCY Seller and Purchaser acknowledge that if they have entered into a client relationship with a Broker, that Xxxxxx has disclosed on a prior basis (1) the types of brokerage relationships offered by the Broker, (2) any other brokerage relationship which would conflict with the client’s interest, and (3) the compensation of Xxxxxx and whether commissions would be shared with other Brokers. The Contractor warrants it is and shall remain in compliance with all applicable local, state and federal laws, regulations, codes and ordinances relating to fire, construction, building, health, food service and safety, including but not limited to the Hotel and Motel Fire Safety Act of 1990, Public Law 101-391. The Judicial Council may terminate this Agreement, pursuant to the termination for cause provision set forth herein, without penalty or prejudice if the Contractor fails to comply with the foregoing requirements.
