Check Retention & Destruction. You agree that all checks belong to you and not to the Credit Union and that those items shall be handled in accordance with this Agreement and your Membership and Account Agreement. After our receipt of a deposit transmission we will acknowledge by electronic means our receipt of such transmission. Your electronic transmission is subject to proof and verification. You will retain the original of all imaged checks that have been deposited via Remote Deposit for a reasonable period of time in order to verify settlement and credit or to balance periodic statements, but in no case beyond thirty-five (35) days from the date processed. It is your responsibility to properly destroy and dispose of such original checks after such time. During the period that you maintain any original checks, you understand and agree that you must use a high degree of care to protect these original checks against security risks. These risks include, without limitation, (i) theft or reproduction of the original checks (including by employees) for purposes of presentment for deposit of these original checks (i.e., after the original checks have already been presented for deposit via the Service) and (ii) unauthorized use of information derived from the original checks. When you dispose of any original checks, you understand and agree that you must use a high degree of care when selecting and implementing disposal procedures to ensure that the original checks are not accessed by unauthorized persons during the disposal process and, once destroyed, the original checks are no longer readable or capable of being reconstructed.

Presentment Prohibitions You shall not present, or attempt to present, or allow others, either directly or indirectly, to present, or attempt to present, for deposit by any means (i) any substitute check that has already been presented for deposit via Mobile Deposit, or (ii) any original check, the substitute check of which has already been presented for deposit via Mobile Deposit. In the event that you or any third party, presents, or attempts to present, a deposit in violation of this Subsection, you agree to defend, indemnify, and hold us and our agents harmless from and against all liability, damage and loss arising out of any claims, suits, or demands brought by third parties with respect to any such substitute check or original check. Among other things, procedures and equipment must be designed to ensure that the original checks are not handled by unauthorized persons and once destroyed the original checks are no longer readable or capable of being reconstructed. • During the retention period, the original checks should be kept in a locking cabinet or safe. Mobile Deposit transmissions will be acknowledged as received electronically. Your electronic transmission is subject to proof and verification. In the event of a deposit dispute when the original check is still in existence, you agree to promptly provide the check upon request by the Credit Union.

Check Retention & Destruction. You agree to retain the original check that was deposited into your account for a minimum of 60 days. During this time you agree to provide the original check to the credit union as soon as possible upon request from us but no later than 2 business days from the time of request. You are responsible for properly handing the check during this period to protect against duplicate deposit and/or re-deposit, theft, or other loss. After the 60 day period you are responsible for properly destroying the check so that unauthorized persons can no longer read, reconstruct, or attempt to deposit the check through the Service or by any other means. Errors You agree to notify the credit union of any suspected errors regarding deposited items through the Service immediately but no longer than 60 days from the date of deposit. Unless you notify us within 60 days of deposit, you are prohibited from bringing a claim against the credit union for alleged error. No claims for alleged error may be brought against the credit union after 60 days or after the original check has been destroyed or otherwise rendered unreadable by the member.

Acceptable commercially means of destruction include shredding (preferably via a cross-cut shredder), burning or pulverizing the original check, after which the Image will be the only evidence of the original check.
