Common use of Appraisal Period Clause in Contracts

Appraisal Period. A regular employee who bumps a more junior employee in accordance with Article 17.03 (Bumping Rights); or who is recalled to employment in accordance with Subsection 17.08 (b), except when re-employed in the same position as occupied before the layoff, shall serve an appraisal period not exceeding six (6) months in the new position. During this period, the employee shall be laid-off and placed on the recall list, if he or she proves unsatisfactory or unable to perform the duties of the new position, or if the employee chooses not to continue in the position.
