Common use of Application of Seniority Clause in Contracts

Application of Seniority. Seniority shall be the determining factor in layoff and recall from layoff, transfers in accordance with job posting procedures, shift changes and vacations, in accordance with the posting provisions of this Section unless ability and qualifications are unequal, in which event seniority will not be the determining factor. Seniority shall be applied in the following manner in accordance with this Section.

Application of Seniority. Seniority shall be the determining factor in layoff and recall from layoff, transfers in accordance with job posting proceduresunit-wide re-bidding and position reassignments, transfers, shift changes, low census, vacation scheduling, Employer initiated schedule changes except as required to satisfy weekend scheduling commitments set forth in Article 7.7, promotions, and vacationsregular job opening where such factors as skill, in accordance with the posting provisions of this Section unless competence and ability and qualifications are unequal, in which event seniority will not be the determining factor. Seniority shall be applied in the following manner in accordance with this Sectionsubstantially equal.

Application of Seniority. 2.1 Seniority shall be the determining factor deciding factor, insofar as the ability of the employee and the conditions of the business will permit, in layoff and recall from layoff, transfers in accordance with job posting procedures, shift changes matters affecting assignment of hours and vacations, in accordance with voluntary and involuntary transfer, promotions, layoffs, and rehiring after layoffs. 2.1.1 In the posting provisions application of this Section unless ability and qualifications are unequalseniority there may arise some occasions when a conflict develops by reason of two (2) or more employees possessing equal seniority. In such cases, in which event applicable seniority will not be determined by the determining factor. Seniority shall be applied in the following manner in accordance with this Sectionorder of dates of birth (mm/dd/yy) of each employee concerned.

Seniority shall be applied in the following manner in accordance with this Sectionsubstantially equal.

Application of Seniority. Seniority shall be the determining factor prevail in layoff regard to layoffs and recall from layofflayoffs. Subject to the operating needs of the Employer, transfers seniority shall also apply in accordance with job posting procedures, shift changes regard to vacation periods and vacations, in accordance with the posting provisions choice of this Section unless ability and qualifications are unequal, in which event seniority will not be the determining factor. Seniority shall be applied in the following manner in accordance with this Sectionworking shifts.
