Acceptance of Reemployment. If a position becomes available for a qualified teacher on ULA, the School District shall mail the notice to such teacher who shall have ten (10) days from the date of such notice to accept the reemployment. Failure to accept, in writing, within such ten (10)-day period shall constitute a waiver on the part of the teacher to any further rights of employment or reinstatement, and that teacher shall forfeit any future reinstatement or employment rights.

Acceptance of Reemployment. If a position that is of the same FTE the teacher was at prior to the leave becomes available for a qualified teacher on ULA, the School District shall mail the notice to such teacher who shall have ten (10) business days from the mailing date to accept reemployment. If a teacher on unrequested leave of absence is offered a position of lesser FTE or outside the field of the position they are on leave from, the teacher may remain on unrequested leave of absence until an equal position is offered or the timeline of 5 years expires. Failure to accept, in writing, within such ten (10) day period shall constitute a waiver on the part of the teacher to any further rights of employment or reinstatement, and that teacher shall forfeit any future reinstatement or employment rights.

The principal shall have ten (10) days from the date of such notice to accept the reemployment. Failure to accept the position, in writing, within such ten (10)-day period shall constitute a waiver on the part of the principal to any further rights of employment or reinstatement, and that teacher shall forfeit any future reinstatement or employment rights to any position with the district. Failure of a notice to reach a principal shall not be the responsibility of the district if such notice has been mailed to the last known address of the principal.

Failure of a full-time or part-time teacher to provide written notice of acceptance of equivalent time reemployment or to report under the provisions outlined in writing, within such ten (10)-day period shall constitute a waiver on the part of the teacher to any further rights of employment or reinstatement, and that teacher shall forfeit any future reinstatement or employment rights.

A teacher-itinerant on unrequested leave does not forfeit the right to reinstatement when accepting a position for less than the full position the teacher-itinerant was placed on leave from; nor does the teacher-itinerant forfeit their right to reinstatement when refusing an offer of recall of less than the ULA’d position. An ECFE/SR/FL teacher on ULA does not forfeit the right to reinstatement when accepting a position for less than the full position the ECFE/SR/FL teacher was placed on leave from; nor does the ECFE/SR/FL teacher forfeit right to reinstatement when refusing an offer of recall of less than the ULA’d position. Failure to accept, in writing, within such ten (10)-day period shall constitute a waiver on the part of the ECFE/SR/FL teacher to any further rights of employment or reinstatement, and that ECFE/SR/FL teacher shall forfeit any future reinstatement or employment rights.
