Underpaying Party definition

Underpaying Party has the meaning set forth in Section 6.7.
Underpaying Party. Underpaying Party shall have the meaning assigned to it in Section 5.13(c). "U.S. Acceptance Date". U.S. Acceptance Date shall have the meaning assigned to it in Section 8.2(a). "U.S. Territory". U.S. Territory shall mean the United States of America and all of its territories and possessions, and shall include Puerto Rico.

  • The failure to pay such deficiency to the Underpaid Party prior to the date that is ten (10) Business Days after receipt of the arbitrator's decision shall not constitute a breach or default by the Underpaying Party under this Agreement.
