Any book debt created upon the sale of a Product and the proceeds of sale of such Product, when received by the Retail Travel Provider, shall be held upon trust by the Retail Travel Provider for the Tour Operator and any proceeds of sale so received by the Retail Travel Provider shall be placed in a bank account on trust for the Tour Operator.
The Tour Operator reserves the right to decline any Booking or request at its absolute discretion.
These Terms and Conditions (“Terms”) are between the Tour Operator and the Retail Travel Provider and apply to the provision of the Services by the Retail Travel Provider.
The Parties agreed that the Travel Agent / Tour Operator shall not be liable to the Customer / Client for indirect damages, any costs, including, but not limited to, legal fees, payments and expenses for the legal /services of lawyers or other specialists, payment for the presence of witnesses, payment based on the ruling on the settlement of disputes, and any other direct and indirect losses which may arise from the breach of the terms of this Agreement / Voucher.
In the event that the Educational Tour Operator has violated the Code of Conduct (EQA) and/or does not comply with the obligations under the written contract, the Education Tour Operator is responsible to respond within 14 days’ time of their corrective action to the School and the Student.
