The Court shall also retain jurisdiction over all questions and/or disputes related to the Notice Program and the Settlement Administrator.
Other than attorney-client communications or communications otherwise protected from disclosure pursuant to law or rule, the Parties shall promptly provide to each other copies of comments, Objections, Opt-Out Requests, or other documents or filings received from a Settlement Class Member as a result of the Notice Program.
The Settlement Administrator shall administer various aspects of the Settlement as described in the next paragraph hereafter and perform such other functions as are specified for the Settlement Administrator elsewhere in this Agreement, including effectuating the Notice Program and distributing the Settlement Fund as provided herein.
Within 30 days of Preliminary Approval of the Settlement and consistent with the schedule set in the Preliminary Approval Order, the Settlement Administrator shall implement the Notice Program provided herein, using the forms of Notice approved by the Court.
Notices provided under or as part of the Notice Program shall not bear or include the Defendant’s logo or trademarks or the return address of Defendant, or otherwise be styled to appear to originate from Defendant.
