Contravention of a notice of listed protected tree species under the National Forests Act, 1998 is regarded as a first category offence that may result in a fine or imprisonment for a period up to three years, or to both a fine and imprisonment.
There appears to be no threat to any protected tree species at the site (National Forests Act No. 84 of 1998).
In terms of Section 12 (1) (d) of this Act and GN No. 1012 (promulgated under the National Forests Act), no person may, except under licence: • Cut, disturb, damage or destroy a protected tree; or• Possess, collect, remove, transport, export, purchase, sell, donate or in any other manner acquire or dispose of any protected tree or any forest product derived from a protected tree.

Permits may also be required under Provincial Nature Conservation Ordinances or the National Forests Act (for destruction of a protected tree species).
Sideroxylon inerme and Pittosporum viridiflorum are listed as protected tree species under the National Forests Act (Act 84 of 1998).
Any disturbance, removal, pruning or transplanting of these species would require a licence from the administrators of the National Forests Act, who are an extension of the Department of Agriculture, Forestry and Fisheries (DAFF) based in Pietermaritzburg.
