Creditors Trustee definition

Creditors Trustee means the trustee to serve pursuant to Article XIV of this Plan and under the Creditors' Trust Agreement.

Creditors Trustee means that person or entity identified in the Creditors Trust Agreement including any successor trustee, the identity of whom shall be subject to the consent of the Committee and Debtors. The Creditors Trustee shall act as the representative of the Estate pursuant to Section 1123(b)(3)(B) with respect to the Creditors Trust Assets in accordance with the terms specified herein and in the Creditors Trust Agreement. The Creditors Trustee shall be deemed to be a party in interest within the meaning of Section 1109(b) and the representative of the Estate for all purposes related to or in connection with the Creditors Trust Assets.

• The Creditors Trustee shall not have any liability to any Creditors Trust Beneficiary or to any Holder of a Claim for the consequences of his or her acts and omissions in the performance of duties under the Plan and Creditors Trust Agreement, except to the extent such consequences are caused by the Creditors Trustee’s intentional and willful misconduct, fraud or gross negligence.

• The identity of the Creditors Trustee shall be disclosed in the Plan Supplement and the Creditors Trustee shall be deemed appointed on the Effective Date.
