As you know, the only potentially relevant analysis performed by our Firm was to review the above-identified Xxxxxxxx application for the sole purpose of considering whether or not the interference requested by Xxxxxx Xxxxxxxx with the Priceline '207 patent could be declared and ultimately concluded adversely to Priceline. We did not consider such other issues as the possible existence of claims (including patent infringement claims) that might be asserted against Priceline, the validity, enforceability, scope or title to any patents or patent applications filed by Priceline, etc. Nevertheless, based on our limited analysis of the above-identified Xxxxxxxx application for the specific purpose noted, we are not currently aware of any error in the aforementioned sections and, on that basis, they appear to be fair and accurate. However, because of the limited nature of our analysis, we cannot, of course, opine on the absolute accuracy or completeness of these sections. We have been asked by xxxxxxxxx.xxx ("Priceline") to relay to you the conclusion we reached with regard to a request filed in the United States Patent and Trademark Office ("PTO") by Xxxxxx Xxxxxxxx for the declaration of an interference between a patent application filed by Xxxxxxxx and Priceline's U.S. patent No. 5,794,207. Based on the materials we reviewed, we have concluded that there is no substantial basis for the interference requested by Xxxxxxxx to be declared and ultimately concluded adversely to Priceline. Of course, we cannot guarantee that a PTO examiner will not declare the interference requested by Xxxxxxxx or that, if declared, the interference will not ultimately be concluded adversely to Priceline.
