In the present matter, as in “The Damianos”, the applicant's tortious claim for compensation in respect of losses sustained in the course of performing the works agreement cannot be determined except by reference to the contractual terms and obligations of the parties. If there was any doubt about this, it disappeared in the course of Xx Xxxxxxx'x submission for the respondent. On the strength of a number of provisions in the agreement he submitted that the arbitrator would be faced with a question of jurisdiction which it would be preferable to commit to the decision of a barrister rather than an engineer. The provisions in question are identical, or nearly so, with a number of those considered by the High Court in Xxxxxxxx- Xxxxxxx International Co. Inc. v. Commonwealth (supra). They are provisions which may in the most general terms be described as “disclaimer” clauses, by which the respondent purports in certain circumstances to limit or exclude responsibilty for the consequences of the applicant's acting on the report or on conclusions derived from the information it contains. Those provisions may conceivably have the effect of denying the applicant any right to the compensation claimed even if its right to compensation was otherwise held to be well founded in law. But that no more involves a question of jurisdiction than does the determination whether an exemption clause in a contract for the sale of goods effectively defeats a claim for damages for breach of that contract. To invoke the description “jurisdiction” to describe the process of determining that a party has contracted to forego his rights under the general law seems to me to represent a Reversion to the confusion of language that prevailed before the decision in Xxxxxx v. Darwins Ltd. [1942] A.C. 356, on which Xx Xxxx rightly relied. The contest ultimately resolved itself into one of whether the proposed arbitrator should be an engineer or a man of law. If I were to choose the latter, the parties were agreed on a named senior counsel of unquestioned competence and experience; if the former, there were two nominees of like competence and experience in their profession. The question is whether an engineer or a barrister would be the most appropriate choice for the inquiry to be undertaken.
