Xxxxx Abuse. An Authorized WIC Vendor who commits fraud or abuse in LA WIC is liable to prosecution under applicable Federal, State, or local laws. Vendors that have willfully misapplied, stolen or fraudulently obtained LA WIC funds will be subject to a fine of not more than $25,000 or imprisonment for not more than five years or both, if the value of the funds is $100 or more. If the value is less than $100, the penalties are a fine of not more than $1,000 or imprisonment for not more than one year or both.
Xxxxx Abuse. It is the Department's belief that the business arrangement contemplated by this Agreement is not subject to the provisions of 42 U.S.C. 1320a-7b(b) prohibiting illegal remunerations. Should the above provisions apply, it is the Department's belief that the business arrangement contemplated by this Agreement meets the discount exception found in 42 U.S.C. 1320a-7b(b)(3)(A), which excludes from prohibited activities the practice of discounting or other reductions in price obtained by a provider of services or other entity under a Federal health care program, if the reduction in price is properly disclosed and appropriately reflected in the costs claimed or charges made by the provider or entity under a Federal health care program. The Department currently provides CMS full and unfettered access to all information held by the Department regarding the implementation of the Illinois Medicaid Program, and shall continue to do so throughout the implementation of the State Supplemental Rebate and Preferred Drug List program.
Xxxxx Abuse. It is Provider Synergies’ and the Participating Medicaid Programs’ intent that the business arrangement contemplated by this Agreement is not prohibited by the provisions of 42 U.S.C. § 1320a-7b(b) , prohibiting certain illegal remuneration, as such provisions may be amended from time to time. In any event, should the provisions of 42 U.S.C. § 1320a-7b(b) apply to this arrangement, it is Provider Synergies’ and Participating Medicaid Programs’ intent that the business arrangement contemplated by this Agreement meets the discount exception found in 42 U.S.C. 1320a-7b(b)(3)(A), and regulatory safe harbor for discounts at 42 C.F.R. § 1001.952(d), each of which as may be amended from time to time. Participating Medicaid Programs currently provide CMS full and unfettered access to all information held by Participating Medicaid Programs regarding the implementation of health care delivery and reimbursement policies, and shall continue to do so throughout the implementation of State Supplemental Rebate and Preferred Drug List programs.

CONTRACTOR shall require such employees, agents, subcontractors, and all other individuals performing services under this Agreement to sign a statement acknowledging the child abuse reporting requirements set forth in Sections 11166 and 11166.05 of the Penal Code and the dependent adult and elder abuse reporting requirements, as set forth in Section 15630 of the WIC, and shall comply with the provisions of these code sections, as they now exist or as they may hereafter be amended.
