Xxxx Village ‐ Master Declaration and Master By‐Laws. The Project is one of potentially over twenty high‐rise condominium projects anticipated to be developed by Seller and/or its affiliates in the vicinity as part of a master planned community called "Xxxx Village." The Project will be part of this urban, mixed‐use master community located in central Kaka’ako, Honolulu. Seller intends to substantially transform the current landscape surrounding the Project over the next decade or more to create the master planned community. Being a part of Xxxx Village, the Project is subject to the Community Covenant for Xxxx Village ("Master Declaration") and By‐Laws of Xxxx Village Owners Association ("Master By‐Laws"), as the same may be amended and/or supplemented from time to time, and any rules and regulations promulgated thereunder, including, without limitation, any master assessments, voting rights, design restrictions and the design review process set forth therein, if applicable. By signing and accepting a Unit Deed, Xxxxxxxxx agrees to carefully review, observe and comply with all covenants, conditions, restrictions and other requirements to which the Project is subject under the Master Declaration and Master By‐Laws, including memberships in the Xxxx Village Owners Association ("Master Association") and the payment of such sums as may be assessed pursuant to such Master Declaration or Master By‐Laws. Further, Seller shall have the reserved right, without the consent of any Owners or such Owners’ mortgagees, to amend the Declaration and to amend the Master Declaration, and to enter into any agreements and to grant easements and to do all things necessary and convenient to effect and implement the purposes of such instruments, and to execute, record and deliver any and all documents necessary to effect the same, including, but not limited to, any amendments to the Declaration and to the Condominium Map.   • Compliance with Consensus Policies and Temporary Policies Registry Operator shall comply with and implement all Consensus Policies and Temporary Policies found at <xxxx://xxx.xxxxx.xxx/general/consensus-­‐policies.htm>, as of the Effective Date and as may in the future be developed and adopted in accordance with the ICANN Bylaws, provided such future Consensus Polices and Temporary Policies are adopted in accordance with the procedure and relate to those topics and subject to those limitations set forth in Specification 1 attached hereto (“Specification 1”).

  • No Physical Presence of Quorum and Participation by Audio or Video; Disaster Declaration The ability of the Board to meet in person with a quorum physically present at its meeting location may be affected by the Governor or the Director of the Ill. Dept. of Public Health issuing a disaster declaration related to a public health emergency. The Board President or, if the office is vacant or the President is absent or unable to perform the office’s duties, the Vice President determines that an in- person meeting or a meeting conducted under the Quorum and Participation by Audio or Video Means subhead above, is not practical or prudent because of the disaster declaration; if neither the President nor Vice President are present or able to perform this determination, the Superintendent shall serve as the duly authorized designee for purposes of making this determination. The individual who makes this determination for the Board shall put it in writing, include it on the Board’s published notice and agenda for the audio or video meeting and in the meeting minutes, and ensure that the Board meets every OMA requirement for the Board to meet by video or audio conference without the physical presence of a quorum.

  • Public Access to Nonprofit Records and Meetings If Contractor receives a cumulative total per year of at least $250,000 in City funds or City-administered funds and is a non-profit organization as defined in Chapter 12L of the San Francisco Administrative Code, Contractor must comply with the City’s Public Access to Nonprofit Records and Meetings requirements, as set forth in Chapter 12L of the San Francisco Administrative Code, including the remedies provided therein.

  • SECTION 109 OF THE HOUSING AND COMMUNITY DEVELOPMENT ACT OF 1974 The Contractor shall comply with the provisions of Section 109 of the Housing and Community Development Act of 1974. No person in the United States shall on the grounds of race, color, national origin, or sex be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity funded in whole or in part with funds made available under this title.   • Allocation and use of scarce resources Any procedures for the allocation and use of scarce resources, including frequencies, numbers and rights of way, will be carried out in an objective, timely, transparent and non-discriminatory manner. The current state of allocated frequency bands will be made publicly available, but detailed identification of frequencies allocated for specific government uses is not required.

  • Education and Prevention 6.1 The policy will be discussed and put forward for adoption on site at a meeting of all workers.

  • Joint Network Implementation and Grooming Process Upon request of either Party, the Parties shall jointly develop an implementation and grooming process (the “Joint Grooming Process” or “Joint Process”) which may define and detail, inter alia:

  • Sanitation and Servicing Purchaser shall take all reasonable precautions to prevent pollution of air, soil, and water by Purchaser’s Operations. If facilities for employees are established on Sale Area, they shall be operated in a sanitary manner. In the event that Purchaser’s Operations or servicing of equipment result in pollution to soil or water, Purchaser shall conduct cleanup and restoration of the polluted site to the satisfaction of Forest Service. Purchaser shall maintain all equipment operating on Sale Area in good repair and free of abnormal leakage of lubricants, fuel, coolants, and hydraulic fluid. Purchaser shall not service tractors, trucks, or other equipment on National Forest lands where servicing is likely to result in pollution to soil or water. Purchaser shall furnish oil- absorbing mats for use under all stationary equipment or equipment being serviced to prevent leaking or spilled petroleum-based products from contaminating soil and water resources. Purchaser shall remove from National Forest lands all contaminated soil, vegetation, debris, vehicle oil filters (drained of free-flowing oil), batteries, oily rags, and waste oil resulting from use, servicing, repair, or abandonment of equipment.
