USE OF ALCOHOL AND OR DRUGS. CONTRACTOR is hereby advised of and further agrees to abide by SANTA FE FIESTA INC., policies regarding the prohibition of and the use of alcohol or drugs during the Santa Fe Fiesta Events. Should CONTRACTOR be found in violation of SANTA FE FIESTA INC. policies, the Santa Fe Fiesta Arts and Crafts and/or Food, Treat/Novelty Chairperson may declare this contract null and void. CONTRACTOR in such a situation will be required to close the booth and remove all personal items from the Event area, at the direction and time specified by the SANTA FE FIESTA INC., Chairperson. SANTA FE FIESTA INC. shall be relieved of any further obligation under this contract, and CONTRACTOR shall not be permitted to conduct any further business and/or sales at the Event. All sums paid for application fees or the like under this contract shall be forfeited.

INDEMNIFICATION XXXXXXXXXX agrees that it shall indemnify and hold harmless SANTA FE FIESTA INC., its officers, directors, and members from any and all causes of action or legal proceedings brought about by actions or conduct of the CONTRACTOR. Should SANTA FE FIESTA INC., be required to employ an attorney to enforce and provisions hereof, or to protect its interest in any manner arising under this contract to collect damages for the breach hereof or to prosecute or defend any lawsuit resulting from this contract or the actions of CONTRACTOR, the CONTRACTOR agrees to reimburse SANTA FE FIESTA INC. for all costs, expenses and attorney fees expended or incurred therein. Initial GOVERNING LAW It is mutually understood and agreed between the parties that the Laws of the State of New Mexico shall govern this contract and venue. In the event of litigation all shall be in held in Santa Fe County, New Mexico.
USE OF ALCOHOL AND OR DRUGS. Employees, while on duty or “on call”, shall not be under the influence of alcohol or drugs, nor have their ability to safely, efficiently and effectively perform the duties of their position impaired as a result of the use of alcohol or drugs. No Employee shall use, possess, sell, deliver or purchase an illegal drug during working hours (including duty-free rest and lunch periods).

  • Alcohol and Drugs Service Provider agrees that the presence of alcohol and drugs are prohibited on the Work Site and while performing their Services. If the Service Provider or any of their agents, employees, or subcontractors are determined to be present or with alcohol or drugs in their possession, this Agreement shall terminate immediately.

  • Alcohol and Drug Testing Employee agrees to comply with and submit to any Company program or policy for testing for alcohol abuse or use of drugs and, in the absence of such a program or policy, to submit to such testing as may be required by Company and administered in accordance with applicable law and regulations.

  • Health, Safety and Environment 41.1 In the performance of this Contract, Contractor and Operator shall conduct Petroleum Operations with due regard to health, safety and the protection of the environment (“HSE”) and the conservation of natural resources, and shall in particular:

  • Fraud, Waste, and Abuse Contractor understands that HHS does not tolerate any type of fraud, waste, or abuse. Violations of law, agency policies, or standards of ethical conduct will be investigated, and appropriate actions will be taken. Pursuant to Texas Government Code, Section 321.022, if the administrative head of a department or entity that is subject to audit by the state auditor has reasonable cause to believe that money received from the state by the department or entity or by a client or contractor of the department or entity may have been lost, misappropriated, or misused, or that other fraudulent or unlawful conduct has occurred in relation to the operation of the department or entity, the administrative head shall report the reason and basis for the belief to the Texas State Auditor’s Office (SAO). All employees or contractors who have reasonable cause to believe that fraud, waste, or abuse has occurred (including misconduct by any HHS employee, Grantee officer, agent, employee, or subcontractor that would constitute fraud, waste, or abuse) are required to immediately report the questioned activity to the Health and Human Services Commission's Office of Inspector General. Contractor agrees to comply with all applicable laws, rules, regulations, and System Agency policies regarding fraud, waste, and abuse including, but not limited to, HHS Circular C-027.
