UNION SECURITY AND DUES CHECKOFF. It is agreed that employees who are now mem- bers or hereafter become members of the Union shall maintain their membership in the Union during the term of this Agreement. It is agreed that all REGULAR bargaining unit employees (as defined in Article clause will be required to pay to the Union, dues (or the equivalent amount) as a condition of continued employment. The University agrees to obtain a signed deduction for the Union dues (or equivalent amount) at the time of com- pleting employment sign-up procedures for all new regular employees. Union Dues Formula Hourly Base Wage x x Local Rate % This is for each position as described in Wage Schedule I and II. The University will be advised by the Treasurer of Local of the Rate % to be used in the formula. The University agrees to deduct from four pays each year an amount equal to one half of the monthly Union dues (or the equivalent amount) for all such regular employees. Such deductions from a REGULAR bargaining unit employee will commence from the first pay in which such employee received remuneration for a complete two week period and shall con- tinue throughout his/her employment in the bargaining unit as outlined in the foregoing paragraph. Inasmuch as such deductions are made from regular employees on twenty four pay peri- ods each year (as outlined above) there are two pay periods each year from which no such deductions are made. It is agreed that the initial deduction from a new regular employee will not occur on such pay period. It is also agreed that no regular bargaining unit employee will be eligible for membership or will become a member of Local of the Canadian Union of Public Employees until completion of the probationary period specified in Article 7 (Seniority). It is further agreed that only those regular employees who have completed the probation- ary period will have recourse to the grievance procedure outlined in this Collective Agreement. The University agrees to deduct from the wages of each TEMPORARY employee (as defined in Article clause who regularly works thirty-five hours or more per week, the same Union dues (or equivalent amount) as that paid by each “regular” bargaining unit employee. Such deductions for temporary employees will commence on the first pay following comple- tion of two full weeks of that pay is one from which union dues (or equivalent amount) for regular full time employ- ees is also deducted. Otherwise the initial deductions will occur on the pay following. Such deductions shall continue thereafter throughout such a period of temporary employment. The total amount deducted in accordance with the foregoing will be remitted by the University, by xxxxxx, addressed to the Treasurer and made payable to the Canadian Union of Public Employees, Local by the fifteenth day of the month following the month for which the deductions have been made, accompanied by a list of the employees from whose wages deductions have been made. A copy of the list shall be forwarded by the University to the National Headquarters of the Canadian Union of Public Employees. It is agreed that the name and current mailing address of each person who, in accordance with this article, is obligated to pay Union dues (or the equivalent amount) will be provided to the Treasurer of Local immediately upon employment of such person.

For the purpose of the Agreement “membership in good standing” in the bargaining unit Union shall consist of the payment by the employee of initiation fees uniformly required of other employees of like status (unless such initiation fees are waived by the Union), plus the payment of dues (as outlined hereinafter described) for each calendar month, plus the payment of assessment(s), within prescribed time limits, as may be levied in accordance with procedures set forth in the foregoing paragraph. Inasmuch as such deductions are made from regular employees on twenty four pay peri- ods each year (as outlined above) there are two pay periods each year from which no such deductions are made. The Company shall then promptly notify the employee involved that s/he is to be discharged from the service of the company and shall promptly take proper steps to discharge said employee as set forth in paragraphs 5 and 6 below. When an employee holding seniority under the Agreement leaves and then returns to the coverage of the Agreement from a position in which s/he was not covered, s/he must resume her/his obligation to the Union within seven (7) calendar days after return. Failure to comply will cause the employee to be discharged as set forth in paragraphs 5 and 6 below. If an employee covered by this Agreement becomes delinquent by more than two calendar months in the payment of monthly dues, including assessments, the Union shall notify the employee in writing, certified mail, return receipt requested, with a copy to the appropriate Company designee that said employee is delinquent in the payment of the monthly membership dues as specified herein and, accordingly, will be subject to discharge as an employee of the Company. Such letter shall be issued in compliance with the policy of the Union regarding Union Security. If any employee fails to initiate membership as described in paragraphs 1 and 2 above; fails to resume membership obligations described in paragraph 3 above; or, becomes delinquent in the payment of dues or fees as described in paragraph 4 above, the Union shall notify, in writing the appropriate Company designee with a copy to the employee, that the employee has failed to comply with the provisions herein and is, therefore, to be discharged. The Company shall then promptly notify the employee involved that s/he is to be discharged from the service of the company, and shall promptly take the proper steps to so discharge the employee. The Company will, within three business days after the receipt of notice from the Union, discharge any employee who is not in good standing in the Union as required in this Section. An employee terminated at the request of the Union as per this Article 7 (Seniority)and under this Agreement shall be deemed to have been discharged for cause and the Company shall not be liable for any wages or pay claims of any type from such employee. It is further agreed that only those regular employees who have completed the probation- ary period will have recourse to the grievance procedure outlined in this Collective Agreement.
