Timeliness and Waiver. Any and all time limits specified in the grievance procedure may be extended by mutual consent of the parties. Failure by the employee or Association to submit or advance the grievance in accordance with these time limits without such waiver shall constitute abandonment of the grievance. Failure by the City to respond within the time limits without such waiver shall advance the grievance to the next step. A grievance may be withdrawn at any time upon the receipt of a signed statement from the Association.

If the County fails to respond within the time limits without such waiver the grievance shall automatically proceed to the next step. A grievance may be withdrawn at any time upon the receipt of the signed statement from the employee or the Association. Any aspect of the grievance procedure may be modified by mutual agreement.
