The Lender's Service Providers. It is agreed by the Borrowers, that without prejudice to any rights of the Lender, all acts/steps as are necessary for the Lender to take in order to monitor/administer the Loan and/or its utilization and/or the obligation of the Borrowers and/or the Borrowers' compliance with the terms hereof and/or to recover amounts due to the Lender, shall and/or may be carried out by and/or through such other person/s (including a company or body corporate) as may from time to time be appointed by the Lender in respect there of and that the Lender will at all times be entitled to share with any such other person that may thus be appointed by the Lender, all documents, statements of accounts and other information of whatsoever nature pertaining to the Borrowers and/or the Loan. The Borrowers expressly recognize and accept that the Lender shall, without prejudice to its right to perform such activities itself or through its officer or servants, be absolutely entitled and have full power and authority to appoint one or more third parties of the Lender's choice and to transfer and delegate to such third parties the right and authority to collect on behalf of the Lender all amounts hereunder and to perform/execute all acts, deeds, matters and things connected therewith or incidental thereto including sending notices of demand, attending the residence or office of the Borrowers or otherwise contacting the Borrowers, receiving the installments in cash/draft/cheque whether in the name of the Lender or in its own name from the Borrowers, entering in to a compromise with the Borrowers, giving a valid receipt and granting effectual discharge to the Borrowers and generally performing all lawful acts as the third parties may consider appropriate for the purpose. For the purpose aforesaid or for any other purpose at the discretion of the Lender, the Lender shall be entitled to disclose to such third parties all necessary or relevant information pertaining to the Borrower and the Loan and the Borrowers hereby consent to such disclosure by the Lender. Notwithstanding the above, the Borrowers expressly accept and authorize the Lender to disclose any such third party information pertaining to the Borrowers and the Loan to any such third party as the Lender may select and the Borrowers hereby consent such disclosure by the Lender.

  • Third Party Service Providers Unless otherwise prohibited by Apple in the Documentation or this Agreement, You are permitted to employ or retain a third party (“Service Provider”) to assist You in using the Apple Software and Services provided pursuant to this Agreement, including, but not limited to, engaging any such Service Provider to maintain and administer Your Applications’ servers on Your behalf, provided that any such Service Provider’s use of the Apple Software and Services or any materials associated therewith is done solely on Your behalf and only in accordance with these terms. Notwithstanding the foregoing, You may not use a Service Provider to submit an Application to the App Store or use TestFlight on Your behalf. You agree to have a binding written agreement with Your Service Provider with terms at least as restrictive and protective of Apple as those set forth herein. Any actions undertaken by any such Service Provider in relation to Your Applications or use of the Apple Software or Apple Services and/or arising out of this Agreement shall be deemed to have been taken by You, and You (in addition to the Service Provider) shall be responsible to Apple for all such actions (or any inactions). In the event of any actions or inactions by the Service Provider that would constitute a violation of this Agreement or otherwise cause any harm, Apple reserves the right to require You to cease using such Service Provider.

  • SERVICE PROVIDER’S OBLIGATIONS 3.1 The Service Provider shall perform its obligations under this Agreement in a reasonable and timely manner in accordance with the provisions of this Agreement.
