Zdravotnické zařízení je oprávněno ukončit tuto Smlouvu s účinností k datu doručení písemné výpovědi Zadavateli, jestliže Zadavatel závažným způsobem poruší kterékoli ustanovení nebo podmínku této Smlouvy a nenapraví toto porušení do třiceti (30) dnů po obdržení písemného oznámení Zdravotnického zařízení o tomto porušení, v němž bude Zdravotnické zařízení specifikovat takové porušení. Xxxx v případě, že Zdravotnické zařízení může ukončit tuto Smlouvu v případě, že Zkoušející bude mít podezření, že dochází k poškození zdraví kteréhokoli ze Subjektů hodnocení v místě provádění klinického hodnocení. Zkoušející může v tomto případě okamžitě pozastavit xxxxx Subjektů hodnocení v místě provádění klinického hodnocení. V takovém případě bude Zdravotnické zařízení bez zbytečného prodlení informovat Zadavatele o takových podezřeních a o svém rozhodnutí pozastavit xxxxx Subjektů hodnocení v místě provádění klinického hodnocení. Zdravotnické zařízení/Zkoušející bude pokračovat s prováděním následných procedur stanovených v této Smlouvě.
Termination by Institution. 8.3 Vypovedanie Zmluvy zo strany Inštitúcie The Institution may terminate this Agreement: (i) if PSI materially breaches this Agreement and fails to cure such breach within thirty (30) calendar days from the receipt of written notice from the Institution; (ii) if the Institution in good faith believe that the continuation of the Study presents an unreasonable medical risk to the Study Subjects; or (iii) upon seventy-five (75) calendar days written notice to the other parties. Inštitúcia môže vypovedať túto Zmluvu: (i) ak PSI závažným spôsobom poruší túto Zmluvu a toto porušenie nenapraví do tridsiatich (30) kalendárnych dní od prijatia písomného oznámenia od Inštitúcie; (ii) ak je Inštitúcia x xxxxxx xxxxx xxxxxxxxxxx, xx pokračovanie Štúdie predstavuje neprimerané zdravotné riziko pre Účastníkov štúdie; alebo (iii) na základe písomnej výpovede adresovanej ostatným stranám sedemdesiatpäť (75) kalendárnych dní vopred.
Termination by Institution. Institution shall have the right to terminate the licenses granted herein, as to any Product in any country, upon written notice to deCODE in the event that after the First Commercial Sale of such Product in such country there is a continuous one (1) year period in which no Product is sold in such country, provided such sale is not prevented by force majeure, government regulation or intervention, or institution of a law suit by any Third Party. Such termination shall be effective sixty (60) days from the date such notice is given, and all deCODE's rights associated therewith shall cease as of that date, subject to Sections 9.5, 11 and 12.
