Scope of Performance; Contract Documents; Term. (a) Artist agrees to perform the live act (the “Performance”) described in the proposal attached hereto as Schedule A (“Artist’s Proposal”), as an independent contractor, and not as an employee of Owner. Artist’s affiliates, officers, directors, shareholders, owners, agents, independent contractors, and employees will not be the affiliates, agents, independent contractors, or employees of Owner. Artist acknowledges and agrees that it is not subject to the direction and control of Owner as to the means and methods of performing the Performance hereunder, provided, however, that Artist is obligated to comply with all of the terms and conditions set forth herein.

  • Review of Performance The Board of Directors shall periodically review and evaluate the performance of Employee under this Employment Agreement with Employee.

  • Return of Performance Bank Guarantee Payment on Order Instrument

  • Time of Performance Time for performance of the Scope of Services under this Agreement shall begin with receipt of the Notice to Proceed and end no later than December 31, 2026. Consultant shall complete the tasks described in the Scope of Services, within this time or within such additional time as may be extended by the County.

  • Schedule of Performance Consultant shall commence the services pursuant to this Agreement upon receipt of a written notice to proceed and shall perform all services within the time period(s) established in the “Schedule of Performance” attached hereto as Exhibit “D” and incorporated herein by this reference. When requested by the Consultant, extensions to the time period(s) specified in the Schedule of Performance may be approved in writing by the Contract Officer but not exceeding one hundred eighty (180) days cumulatively.

  • Term and Time of Performance The effective date of this Agreement shall begin on July 1, 2018 and will continue through June 30, 2023, subject to appropriation of funds, notwithstanding any other provision in this agreement.

  • EXCUSE OF PERFORMANCE Seller shall not be liable for delays in performance or for non-performance due to failure or interruption of computer or telecommunication systems, acts of God, war, riot, fire, terrorism, labor trouble, unavailability of materials or components, explosion, accident, compliance with governmental requests, laws, regulations, orders or actions, or other unforeseen circumstances or causes beyond Seller's reasonable control. In the event of such delay, the time for performance or delivery shall be extended by a period of time reasonably necessary to overcome the effect of the delay.
