Road Transport Safety. In the event the Supplier or its Sub-contractors are transporting people or Products to, from or for or on behalf of Purchaser on public or other Offsite Roads, and in the case of Products: (a) where such Products constitute the majority of the load being carried by the Supplier or its Sub-contractors and where such Products are being carried by a Heavy Vehicle; or (b) where such Products constitute dangerous goods or hazardous substances, materials or waste as per Environmental Laws; or

Road Transport Safety. In the event the Contractor or its Sub-contractors are transporting people or Products to, from or for or on behalf of Purchaser on public or other Offsite Roads, and in the case of Products: (a) where such Products constitute the majority of the load being carried by the Contractor or its Sub-contractors and where such Products are being carried by a Heavy Vehicle; or (b) where such Products constitute dangerous goods or hazardous substances, materials or waste as per Environmental Laws; or (c) where otherwise required by Purchaser, the Contractor shall, and shall ensure that its Sub- contractors, have a transport safety management system in place to eliminate or minimise the potential for fatalities, injuries and/or environmental damage arising from such transportation Purchaser ("Transport Safety Management System") irrespective of when risk of loss or damage or title in the Products passes to. The Contractor’s Transport Safety Management System shall, at a minimum, comply with the public or other Offsite Roads transport requirements set out in Schedule B and to any other terms reasonably requested by Purchaser, including those related to health and safety. Purchaser reserves the right to audit the compliance of the Contractor with the requirements of this Section 21. The Contractor agrees to participate in performance review meetings with Purchaser to review safety performance, including, without limitation. incidents and corrective actions taken; audit results; driver turnover rates; relevant operational or organization changes, route risk assessment and other items of interest.
