Right to Displace Less Senior Teacher. 1. A teacher who is notified that he/she is to be laid off will have the right to displace any less senior teacher whose work he/she is certificated and/or licensed to perform. Written notice to exercise this right must be made to the Superintendent within ten (10) calendar days after a teacher is notified that he/she is to be laid off.

Right to Displace Less Senior Teacher. 1. A bargaining unit member who is notified that he/she is to be laid off will have the right to displace any less senior bargaining unit member whose work he/she is certificated to perform. Written notice to exercise this right must be made to the Superintendent within five (5) work days after a bargaining unit member is notified that he/she is to be laid off. All displacements must occur by August 10. Bumping (displacement) rights shall accrue to all teachers within their respective contract status groups (continuing contract, or limited contract), but in no event shall a non-tenured teacher exercise bumping rights over tenured teachers. The right to bump shall be limited to teacher's area of Certification/Licensure and those with comparable or lower evaluations.

  • Right to Refuse to Cross Picket Lines All employees covered by this Agreement shall have the right to refuse to cross a picket line arising out of a dispute as defined in the Labour Relations Code of British Columbia. Any employee failing to report for duty shall be considered to be absent without pay. Failure to cross a picket line encountered in carrying out the Employer's business shall not be considered a violation of this Agreement nor shall it be grounds for disciplinary action.
