Resale of Product. Any Project Participant may direct CCP to remarket such Project Participant’s Entitlement Share of the Product, or such Project Participant’s Entitlement Share of any part of the Product. If CCP incurs any expenses associated with the remarketing activities pursuant to this Section 5.1(j), then CCP shall include the total amount of such expenses as a Monthly Cost on the Project Participant’s next Billing Statement. Prior to offering the Project Participant’s Entitlement Share of the Product, or the Project Participant’s Entitlement Share of any part of the Product to any third party, CCP shall first offer the Product or portion of the Product to the other Project Participants. The amount of compensation paid to the selling Project Participant shall be negotiated and agreed to between the selling Project Participant and the purchasing Project Participant or third party. Any payments for any resold Product pursuant to this Section 5.1(j) shall be transmitted directly from the purchasing Project Participant or purchasing third party to the reselling Project Participant. Any such resale to a third party shall not convey any rights or authority over the operation of the Project, and the Project Participant shall not make a representation to the third party that the resale conveys any rights or authority over the operation of the Project.
Resale of Product. Buyer will not resell or otherwise transfer Product to any other party without the express prior written authorization of Seller. 22.
Resale of Product. 16.1 Unless Customer is a CAE Healthcare authorized distributor of Products, Customer is prohibited from purchasing Products to resell same for profit, or to resell the Products for profit.
Resale of Product. Buyer agrees the purchase of Product under the terms and conditions of this Contract are for Buyer’s sole use exclusively in the Injection Projects and that Buyer shall not resell or exchange Product delivered hereunder to any third party. Produced gas (including Carbon Dioxide) from the Injection Projects is owned by the working interest owners for their own use and may be used or sold at their sole discretion.
Resale of Product. Customer represents to Supplier that within 180 business days after title passes to Customer pursuant to Section 6, Customer will resell such Product to unrelated third parties (“Resale Transaction”). In no event shall any Product purchased under this Agreement be utilized or otherwise consumed prior to the resale of such Product pursuant to a Resale Transaction.”
Resale of Product. Distributor will resell Products to Customers, after verifying Customer licenses to purchase Products, at no more than the List Price set forth in Exhibit A, except in the case where a Customer elects to pay Distributor on payment terms longer than net 30 days, in which case Distributor may sell Products at a price higher than the List Price,
Resale of Product. Sankyo will not purchase or resell the Product without the prior written permission of Cygnus.
Resale of Product. Edison shall purchase product from ITI under this Agreement only for resale to ultimate end-users and/or authorized Edison Dealers operating under the Edison name ("AUTHORIZED DEALERS"). Edison shall not resell product to anyone other than a bona fide end-user and/or Authorized Dealers, and represents to ITI that Edison does not intend to purchase product from ITI with an intention to distribute such product to others for resale (other than Authorized Dealers). Edison acknowledges that Edison is not the exclusive dealer of ITI for any product or geographic area and that ITI reserves to itself the unrestricted right to sell product in any geographic area, including Edison's trade area, directly to any distributor, dealer, individual or entity.
Resale of Product. INTEL may resell Product purchased hereunder to third parties in its discretion. Notwithstanding the forgoing, INTEL shall provide MICRON with prior written notice of its intent to resell such Products, and shall offer to sell such Products, whether still in discrete form or assembled onto modules, to MICRON on identical terms and conditions as such Products were originally purchased by INTEL from MICRON, provided that if such Products were assembled into module form by INTEL, the price for such Products shall be equal to INTEL’s actual cost of components plus its actual cost incurred to assemble such Products into module form.
Resale of Product. Westar shall purchase product from ITI under this Agreement only for resale to ultimate end-users and/or authorized Westar Dealers operating under the Westar name ("AUTHORIZED DEALERS"). Westar shall not resell product to anyone other than a bona fide end-user and/or Authorized Dealers, and represents to ITI that Westar does not intend to purchase product from ITI with an intention to distribute such product to others for resale (other than Authorized Dealers). Subject to the provisions of SUBPARAGRAPH 8.B. above, Westar acknowledges that Westar is not the exclusive dealer of ITI for any product or geographic area and that ITI reserves to itself the unrestricted right to sell product in any geographic area, including Westar's trade area, directly to any distributor, dealer, individual or entity.
