Receipt of Check Images. We reserve the right to reject any check image transmitted through the Service, at our discretion. We are not responsible for check images we do not receive or for images that are dropped or become corrupted or illegible during transmission. An image of a check shall be deemed received when you receive an “accepted status” confirmation from the Service that we have received the check image (if there are issues with the check image, a “deposit failed” message should display). Receipt of such confirmation does not mean that the transmission was error-free or complete, or that your Authorized account will not be charged back for the amount of the deposit and any applicable returned deposited item or other fee under the Account agreement if the check image presented is dishonored or returned unpaid for any reason by the financial institution on which it is drawn.

Receipt of Check Images. Upon receipt of the check image via the Service, we may examine the check image and convert it into a “substitute check” to facilitate the deposit and collection. Electronically transmitting a check to us does not constitute receipt by us. Log on to HIFICU’s Home Branching Service to confirm that the check has been posted to the correct account for the proper amount. Our posting of a check does not mean that the image contains no errors, that we are responsible for any information you transmit to us, that funds are available for withdrawal, or that HIFICU received payment from the issuer of the check. All deposits are subject to verification and may be adjusted upon our review. We reserve the right, within our sole and absolute discretion, to reject any remote deposit into your Account. You agree that HIFICU is not liable for any loss, costs, or fee you may incur as a result of our chargeback of an ineligible check. You understand that any amount credited to your Account for checks deposited using the Service is a provisional credit and you agree to indemnify us against any loss we suffer because of our acceptance of the remotely deposited check. You agree to regularly review your account transaction history to confirm whether or not transactions have been processed properly, and to contact us immediately in the event of any discrepancy.

  • Receipt of Items We reserve the right to reject any Image or Item transmitted through the Service, at our discretion, without liability to you. We are not responsible for Images we do not receive or for Images that are dropped during transmission. An Image of an Item shall be deemed received only when you receive a confirmation from us that we have received the Image and accepted your deposit. However, the confirmation that we send you does not mean that the transmission was complete or error free.

  • Receipt of Goods The goods shall be deemed received by Buyer when delivered to Buyer at City of Naples, 000 Xxxxxxxxx Xxxxxx, Xxxxxx, Xxxxxxx 00000. Delivery of the goods to Buyer shall occur on a business day and shall not occur after 3:15 p.m. on the delivery day.

  • RECEIPT OF AGREEMENT Each of the parties hereto acknowledges that it or he has read this Agreement in its entirety and does hereby acknowledge receipt of a fully executed copy thereof. A fully executed copy shall be an original for all purposes, and is a duplicate original.

  • SHIPPING/RECEIPT OF PRODUCT a. Packaging Product shall be securely and properly packed for shipment, storage and stocking in appropriate, clearly labeled shipping containers and according to accepted commercial practice, without any extra charges for packing materials, cases or other types of containers. The container shall become and remain the property of the Authorized User unless otherwise specified in the Contract documents.

  • Receipt of Product The Contractor shall be solely responsible for assuring that deliveries are made to personnel authorized to accept delivery on behalf of the Authorized User. Any losses resulting from the Contractor’s failure to deliver Product to authorized personnel shall be borne exclusively by the Contractor.

  • Receipt of Documents The Investor and its counsel has received and read in their entirety: (i) this Agreement and the Exhibits annexed hereto; (ii) all due diligence and other information necessary to verify the accuracy and completeness of such representations, warranties and covenants; (iii) the Company's Form 10-KSB for the year ended year ended December 31, 2003 and Form 10-QSB for the period ended September 30, 2003 and (iv) answers to all questions the Investor submitted to the Company regarding an investment in the Company; and the Investor has relied on the information contained therein and has not been furnished any other documents, literature, memorandum or prospectus.

  • After receipt of card When you receive the card, you must immediately sign on the card. You are deemed to have accepted and agreed to this agreement when you retain or use the card.

  • Electronic Re-presented Checks If you write a check on a personal account that we return unpaid because of insufficient or uncollected funds, payee or any subsequent holder of the check may re-present the check to us, through an electronic instruction ("Electronic Re-presented Check") to charge your account for the amount of the check. If we receive an electronic re-presented check, we will pay or return the electronic re-presented check as if the original paper check was presented to us. Any collection fee you authorize the merchant to debit from your account is an electronic funds transfer subject to the terms of the Electronic Funds Transfer Agreement. If you want to reverse an electronic re-presented check, you must give us an affidavit within fifteen (15) days after we send or make available to you the periodic statement that reflects payment of that electronic re-presented check. In your affidavit, you must declare and swear under oath that the electronic re-presented check was ineligible or unauthorized. If we receive a proper notice of affidavit from you within the 15-day period, we will recredit your account with the amount of the charge. If you wish to stop payment of any electronic re-presented check, you must follow the procedures for stopping payment of checks, not the procedures for stopping payment on electronic loan or bill payments. If you ask us to request the depositor's bank to send us the original paper check or a copy of the paper check, and we provide it to you, you agree that you will not seek to have your account re-credited due to a prior stop payment order or if the item is otherwise ineligible for collection.
