Product Warnings for Existing Inventory. As of October 1, 2016, Tenacious shall not sell or ship any Covered Product that is not Phthalate Free, as defined in Section 2.2 herein, into California, to a California customer or distributor, or to a non-California customer or distributor that Tenacious reasonably understands maintains retail outlets in California. To the extent that Covered Product manufactured before October 1, 2016, is sold or shipped from existing inventory, it shall not be sold or shipped to California customers or distributors and, in any event, shall include the following warning language printed on the label of each such Covered Product in no less than 6 point font size: WARNING: This product contains chemicals known to the State of California to cause cancer and birth defects or other reproductive harm. Each warning shall be prominently placed with such conspicuousness as compared with other words, statements, designs, or devices as to render it likely to be read and understood by an ordinary individual under customary conditions before purchase or use. Each warning shall be provided in a manner such that the consumer or user understands to which specific Covered Product the warning applies, so as to minimize the risk of consumer confusion. Tenacious represents as a material part of this Agreement that it currently does not sell a material number of Covered Product directly through an internet e-commerce website or a printed catalog. Based upon this representation, this Agreement does not include any obligations for clear and reasonable warnings as it relates to such methods of commerce.

Product Warnings for Existing Inventory. After November 1, 2016, for any inventory of Covered Product in AHI’s possession, custody or control as of its execution of this Agreement, AHI shall not sell or ship any Covered Product to a vendor or retailer that sells to or into California, or sell or ship any Covered Product to a vendor or retailer that AHI reasonably understands maintains retail outlets in the California, unless such Covered Products are sold or shipped with one of the clear and reasonable warnings set forth hereafter. Each warning shall be prominently placed with such conspicuousness as compared with other words, statements, designs, or devices as to render it likely to be read and understood by an ordinary individual under customary conditions before purchase or use. Each warning shall be provided in a manner such that the consumer or user understands to which specific Covered Product the warning applies, so as to minimize the risk of consumer confusion. After October1, 2016, AHI shall not distribute or otherwise sell any Covered Product unless it is Phthalate Free and shall not sell any Covered Products that are not Phthalate Free in or into California regardless of whether or not a Proposition 65 warning accompanies the product.

  • Catalog Information about Community Regional Medical Center – Diagnostic Medical Sonography Program (CRMC-DMSP) is published in a school catalog that contains a description of certain policies, procedures, and other information about the school. CRMC-DMSP reserves the right to change any provision of the catalog at any time. Notice of changes will be communicated in a revised catalog, an addendum or supplement to the catalog, or other written format. Students are expected to read and be familiar with the information contained in the school catalog, in any revisions, supplements and addenda to the catalog, and with all school policies. By enrolling in CRMC-DMSP, the Student agrees to abide by the terms stated in the catalog and all school policies.

  • Mail Order Catalog Warnings In the event that, the Settling Entity prints new catalogs and sells units of the Products via mail order through such catalogs to California consumers or through its customers, the Settling Entity shall provide a warning for each unit of such Product both on the label in accordance with subsection 2.4 above, and in the catalog in a manner that clearly associates the warning with the specific Product being purchased. Any warning provided in a mail order catalog shall be in the same type size or larger than other consumer information conveyed for such Product within the catalog and shall be located on the same display page of the item. The catalog warning may use the Short-Form Warning content described in subsection 2.3(b) if the language provided on the Product label also uses the Short-Form Warning.

  • ODUF Packing Specifications 6.3.1 The data will be packed using ATIS EMI records. A pack will contain a minimum of one (1) message record or a maximum of ninety-nine thousand nine hundred and ninety-nine (99,999) message records plus a pack header record and a pack trailer record.   • API If the Software offers integration capabilities via an API, your use of the API may be subject to additional costs or Sage specific policies and terms and conditions (which shall prevail in relation to your use of the API). You may not access or use the API in any way that could cause damage to us or the Software, or in contravention of any applicable laws. We reserve the right in our sole discretion, to: (i) update any API from time to time; (ii) place limitations around your use of any API; and (iii) deny you access to any API in the event of misuse by you or to otherwise protect our legitimate interests.
