Procurement Protest or Challenge. Operations Co acknowledges the provisions of Section 3.10 of the Project Agreement and agrees to assist in the defense of any protest or challenge to the procurement process contemplated thereunder. Operations Co will pay any costs incurred in defending the actions of Operations Co related to the procurement process or to its interests in this Project Implementation Agreement.. Project Co agrees to enforce its contractual rights under Section 3.10 of the Project Agreement against the Authority in accordance with the Pass-Down Provisions.

Procurement Protest or Challenge. The Authority will defend any protest or other challenge to the procurement process pursuant to which Project Co was selected to enter into this Project Agreement or to the Authority’s or Project Co’s right to proceed with the Project or any aspect thereof in connection with the procurement, to the extent that such protest or other challenge was denied following an initial review by the Secretary of the Finance and Administration Cabinet and the protester or challenger is seeking an injunction or other order of a court of competent jurisdiction resulting therefrom. The Authority will pay any costs incurred in defending the actions of the Authority related to the procurement process and the determination of the Secretary of the Finance and Administration Cabinet. Project Co agrees to assist in the defense of the protest or challenge to the procurement process and will pay any costs incurred in defending the actions of Project Co related to the procurement process or to its interests in this Project Agreement. In connection with any legal proceedings related to a protest or other challenge to the procurement process as contemplated hereby, the parties, acting reasonably and in the best interests of the Project, will consider requesting that the protester or challenger be required to post an injunction bond.

  • Complaints and Feedback 15.3.1 The primary responsibility for receiving feedback and investigating complaints promptly and thoroughly in respect of the Services will rest with the Provider. The Provider will have procedures in place including but not limited to a complaints framework, which are acceptable to the Department, to gather and act upon feedback and complaints from Learners and/or their representatives and employers and the wider community. The Provider must also keep a log of the complaints received which will be accessible to the Department upon request.

  • Notification of Government Investigation or Legal Proceedings Within 30 days after discovery, Xxxxx shall notify OIG, in writing, of any ongoing investigation or legal proceeding known to Xxxxx conducted or brought by a governmental entity or its agents involving an allegation that Xxxxx has committed a crime or has engaged in fraudulent activities. This notification shall include a description of the allegation, the identity of the investigating or prosecuting agency, and the status of such investigation or legal proceeding. Xxxxx shall also provide written notice to OIG within 30 days after the resolution of the matter, and shall provide OIG with a description of the findings and/or results of the proceedings, if any.

  • Complaints Investigation ‌ An employee who complains of harassment under the provisions of the Human Rights Code of British Columbia may refer the complaint to either one or other of the following processes:

  • Initiation of Grievance When a dispute arises, an attempt shall be made by the Faculty Member to settle the grievance with the appropriate management representative. Failing a satisfactory solution, the Faculty Association shall initiate an informal meeting between the Grievor, a Faculty Association representative and the relevant Xxxx or the administrative supervisor in the case of a Librarian or Counsellor within ten working days after the situation leading to the grievance has arisen or within ten working days from the time the Faculty Member should reasonably have known of the occurrence of the situation giving rise to the grievance.

  • Assistance in Litigation or Administrative Proceedings Covered Entity shall provide written notice to Business Associate if litigation or administrative proceeding is commenced against Covered Entity, its directors, officers, or employees, based on a claimed violation by Business Associate of HIPAA, the HIPAA Rules or other laws relating to security and privacy or PHI. Upon receipt of such notice and to the extent requested by Covered Entity, Business Associate shall, and shall cause its employees, Subcontractors, or agents assisting Business Associate in the performance of its obligations under the Contract to, assist Covered Entity in the defense of such litigation or proceedings. Business Associate shall, and shall cause its employees, Subcontractor’s and agents to, provide assistance, to Covered Entity, which may include testifying as a witness at such proceedings. Business Associate or any of its employees, Subcontractors or agents shall not be required to provide such assistance if Business Associate is a named adverse party.

  • Investigation of Grievances The investigation of grievances shall not interfere with the orderly process of education in District 281.
