Plugging and Abandonment of Xxxxx. (a) Buyer shall not at any time abandon, relinquish, surrender, or otherwise permit to expire its leasehold interest in any Lease, or plug and abandon the last producing well or xxxxx capable of production from the Shallow Rights on the applicable Lease acreage, without first giving Seller written notice of such desire and intention at least sixty (60) days before said leasehold interest is to be abandoned, relinquished, surrendered, or otherwise permitted to expire, or the last producing well or xxxxx capable of producing from the Shallow Rights on the applicable Lease is to be plugged and abandoned. Seller shall have thirty (30) days after receipt of such notice within which to notify Buyer whether Seller elects to take over the leasehold interest of Buyer in the applicable Lease. If Seller elects to take over the leasehold interest of Buyer in any Lease, Buyer shall promptly assign to Seller such leasehold interest, using the form of assignment in Exhibit B-1 for a Texas Lease or Exhibit B-2 for a Louisiana Lease.

Plugging and Abandonment of Xxxxx. In accordance with state law and this Agreement, Operator shall plug and abandon all of the xxxxx shown on Exhibit D (“P&A Xxxxx”), attached hereto and incorporated herein by reference. The Operator shall properly drain, plug and decommission in accordance with City and COGCC rules and regulations all flowlines and pipelines associated with the P&A Well(s) and shall remove all facilities related to the P&A Xxxxx taking into consideration the terms of the governing surface use agreement. If a waiver or variance is required by the COGCC for Operator’s planned reclamation, Operator will also obtain a waiver or variance from the City. The plugging and abandoning of a particular P&A Well shall commence within one hundred and twenty (120) days following the commencement of production from a New Well located in each of the COGCC drilling and spacing units encompassing the leasehold originally drilled by such P&A Well. Operator agrees that any well that Operator plugs and abandons, either before or after the Effective Date, may not be re-entered by Operator.
Plugging and Abandonment of Xxxxx. There are no Xxxxx operated by Seller and located on the Land that (i) Seller is obligated by Law or contract to plug and abandon at this time; or (ii) have been plugged and abandoned but have not been plugged in accordance with all applicable requirements of each Governmental Authority having jurisdiction over the Interests.

  • Abandonment of Premises If the property becomes vacant during the term of this lease, and if at the time of the vacancy Tenant are in default in the payment of any installment of rent, then the rent for the entire term shall become at once due and payable and Landlord may proceed to collect rent for said entire premises, with or without process of law, to take possession thereof, to remove any and all property there from and store as required by law, to lease the premises as agent of Tenant, and to apply the proceeds received from such letting toward the payment of Tenant' rent under this lease; such re-entry and re-letting shall not discharge Tenant from liability for rent, nor from any other obligation under the terms of this lease.
