People you may nominate to act for you in this agreement. If you request a Direct Payment you will be assessed to determine your willingness, ability and competence to manage a Personal Budget in this way before your Personal Budget is agreed. This assessment will also determine whether you have adequate support to assist you with managing your Direct Payment or whether you need someone (such as the Council) to manage it for you. If you need someone to manage your Direct Payment for you this person will be assessed as to whether they are suitable. This person is referred to in this agreement as a “Nominee”. A Nominee will be required to provide two documents evidencing their identity. A Nominee agreeing to act on your behalf and manage your Direct Payment for you takes on legal responsibility in respect of this agreement. (Care Staff please delete as appropriate) It is desirable, but not essential, that your Nominee holds; an Enduring, Limited, or Lasting Power of Attorney (property and financial affairs), or be a Court Appointed Deputy A Nominee will be legally responsible to repay to the Council all payments by the Council under this agreement that have not been used in accordance with this agreement. Where the Personal Budget Holder is an adult without the mental capacity to consent and a Lasting Power of Attorney (health and welfare) has been actioned it may be possible for a Direct Payment to be made subject to all parties being satisfied that this is in the best interest of the person concerned.   • Certification of Meeting or Exceeding Tobacco-Free Workplace Policy Minimum Standards A. Grantee certifies that it has adopted and enforces a Tobacco-Free Workplace Policy that meets or exceeds all of the following minimum standards of:

  • Subpoenas Directed to BellSouth Where BellSouth provides resold services or local switching for <<customer_name>>, BellSouth shall respond to subpoenas and court ordered requests delivered directly to BellSouth for the purpose of providing call detail records when the targeted telephone numbers belong to <<customer_name>> end users. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request.
