Ownership of PHI. For purposes of this BAA, CE owns the data that contains the PHI it transmits to BA or that BA receives, creates, maintains or transmits on behalf of CE.
Ownership of PHI. Except as specified in Section 2.2 above or as otherwise agreed to in writing by both parties, as between Covered Entity and HeL, Covered Entity holds all right, title and interest in and to any and all PHI received by HeL from, or created or received by HeL on behalf of, Covered Entity, and HeL does not hold, and will not acquire by virtue of this Agreement or by virtue of providing any services or goods to Covered Entity, any right, title or interest in or to such PHI or any portion thereof.
Ownership of PHI. Business Associate acknowledges that all right, title and interest in and to any PHI furnished to Business Associate vests solely and exclusively with Covered Entity or the Individual to whom such PHI relates.
Ownership of PHI. Business Associate acknowledges and agrees that UCMC owns all right, title and interest in and to all PHI, and that such right, title and interest will be vested in UCMC. Neither Business Associate nor any of its employees, agents, consultant or assigns will have any rights in any of the PHI or to use the PHI in any form, including stripped or aggregated information or statistical information derived from or in connection with the PHI, except as expressly permitted in this Agreement. Business Associate will not compile or distribute analysis to third parties using any PHI without UCMC’s express written consent.
Ownership of PHI. The exchange of Electronic PHI under this Agreement does not change the ownership of such information under state, federal, or any other applicable law. If Electronic PHI has been exchanged for a permitted purpose, it may thereafter be integrated into the records of Business Associate’s participants, and the parties acknowledge that such information cannot be returned upon termination of this Agreement.
Ownership of PHI. The PHI to which Business Associate, or any agent or subcontractor of Business Associate has access under the Agreement shall be and remain the property of Covered Entity.
Ownership of PHI. PHI is and remains the property of Covered Entity as long as Business Associate creates, receives, maintains, or transmits PHI, regardless of whether a compliant Business Associate agreement is in place.
Ownership of PHI. The PHI and any related information created for or received from Covered Entity is, and will remain, the property of Covered Entity. Business Associate agrees that it acquires no ownership rights to, or title in, the PHI or any related information.
Ownership of PHI. We acknowledge that, as between you and us, all PHI shall be and remain your sole property, including any and all forms thereof developed by us in the course of its fulfillment of our obligations pursuant to this Agreement.
Ownership of PHI. Under no circumstances shall Business Associate be deemed in any request to be the owner of any PHI used or disclosed by or to Business Associate by Covered Entity.
