Business Associate Agreement. The Parties acknowledge that CITY is a Covered Entity as defined in the Healthcare Insurance Portability and Accountability Act of 1996 (“HIPAA”) and is required to comply with the HIPAA Privacy Rule governing the access, use, disclosure, transmission, and storage of protected health information (PHI) and the Security Rule under the Health Information Technology for Economic and Clinical Health Act, Public Law 111-005 (“the HITECH Act”). The Parties acknowledge that CONTRACTOR will:
Business Associate Agreement. Contractor and County shall comply with the County’s Business Associate Agreement in accordance with Exhibit F, a copy of which is attached hereto and incorporated herein by reference.
Business Associate Agreement. The Parties agree that in order to implement the PPS Project, they may need to exchange PHI. The Parties have entered into a Business Associate Agreement that covers the exchange of PHI that may occur pursuant to this Agreement, or shall enter into a Business Associate Agreement, as a condition of entering into this Agreement.

If performance of this Contract results in Contractor becoming a “business associate” of UConn Health under the requirements of the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), Contractor must comply with all terms and conditions of this Business Associate Agreement section of the Contract (this “BAA”). If Contractor is not UConn Health’s “business associate” under HIPAA, this BAA does not apply to Contractor. Contractor is required to safeguard the use, publication and disclosure of information about individuals that it creates, maintains, transmits or receives pursuant to this Contract, in accordance with all applicable federal and state laws regarding confidentiality, including, without limitation, HIPAA and more specifically the Privacy and Security Rules at 45 C.F.R. part 160 and part 164, subparts A, C, and E; and Contractor and UConn Health agree to this BAA in order to comply with HIPAA, the requirements of Subtitle D of the Health Information Technology for Economic and Clinical Health Act (Pub. L. 111-5, §§ 13400 to 13423) (“HITECH Act”), and more specifically with the Privacy and Security Rules at 45 C.F.R. part 160 and part 164, subparts A, C, D and E (collectively referred to herein as the “HIPAA Standards”).
Business Associate Agreement. The Business Associate Agreement attached hereto shall govern all matters necessary to enforce the provisions of the HIPAA Privacy and Security Rules 45 CFR Parts 160, 162, and 164 as applicable to this contract.

Business Associate Agreement. Contractor will ensure that any subcontractor of Contractor who has access to HHSC Confidential Information will sign a HIPAA-compliant Business Associate Agreement with Contractor, and Contractor will submit a copy of that Business Associate Agreement to HHSC upon request.
Business Associate Agreement. The ACO, acting as the Agency’s Business Associate, performs certain services on behalf of or for the Agency pursuant to this Agreement that require the exchange of information that is protected by the Health Insurance Portability and Accountability Act of 1996, as amended, and the federal regulations published at 45 CFR part 160 and 164. The Business Associate agrees to comply with the Business Associate Agreement Addendum (BAA), and any amendments thereof, as posted to the Agency’s website: xxxx://xxx.xxx.xxxxx.xx.xx/Consumers/Health/HIPAA/Home.html By signing this Agreement, the Business Associate consents to receive notice of future amendments to the BAA through electronic mail. The Business Associate shall file and maintain a current electronic mail address with the Agency for this purpose. The Agency may amend the BAA by posting an updated version of the BAA on the Agency’s website at: xxxx://xxx.xxx.xxxxx.xx.xx/Consumers/Health/HIPAA/Home.html and providing the Business Associate electronic notice of the amended BAA. The Business Associate shall be deemed to have accepted the amendment unless the Business Associate notifies the Agency of its non-acceptance in accordance with the Notice provisions of the Agreement within 30 days of the Agency’s notice referenced herein. Any agreed alteration of the then current Agency BAA shall have no force or effect until the agreed alteration is reduced to an Agreement amendment that must be signed by the Business Associate, Agency Director, and the Agency Security and Privacy Officer.
Business Associate Agreement. HEALTHeLINK acknowledges that, as a health information exchange organization that operates an electronic health information exchange, it is a Business Associate of Participant (as such term is defined by HIPAA). As such, it shall maintain the security and privacy of Protected Health Information in accordance with the provisions of the Business Associate Agreement that is attached hereto as Exhibit A and incorporated herein by reference.
