Other Forms of Alternative Dispute Resolution (ADR). By mutual agreement between the Council and the Employer, a grievance may be submitted for mediation before the Bureau of Mediation Services at any time prior to the arbitration hearing. Additionally, by mutual agreement between the Council and the Employer, the parties may use any other form of ADR to resolve a grievance prior to the arbitration hearing. Any expenses for the ADR practitioner’s service and the proceeding shall be borne equally by the Appointing Authority and the Council. Unless the Employer and the Council agree otherwise, if either party cancels an ADR proceeding or asks for a postponement that leads to the ADR practitioner charging a fee, then the party initiating the cancellation or the postponement shall pay this fee.

  • Negotiation; Alternative Dispute Resolution The Parties will attempt in good faith to resolve any dispute or controversy arising out of or relating to the performance of services under this Agreement. If the Parties are unable to resolve the dispute, then, pursuant to San Francisco Administrative Code Section 21.36, Contractor may submit to the Contracting Officer a written request for administrative review and documentation of the Contractor's claim(s). Upon such request, the Contracting Officer shall promptly issue an administrative decision in writing, stating the reasons for the action taken and informing the Contractor of its right to judicial review.
