Operating Inputs. The User covenants and agrees to provide, or cause to be provided, to the Trust or its designee if not available to the Trust or its designee from third parties on commercially reasonable terms, the fuel (including fuel oil and propane), traditional stocked items (including paper, light bulbs and valve packing), process related chemicals (including, without limitation, ferrous chloride, polyelectrolytes, lime, iron, aluminum salts, aluminum sulfate and liquid nitrogen), diesel oil, diesel fuel, sand, lubricating oils and greases and other commodities useful or necessary to operate the Facility at its Maximum Dependable Capacity (the “Operating Inputs”). The User further agrees to procure the Operating Inputs on the best terms then available to it, and to pass on to the Trust or its designeesdesignee, the benefit of any prices or price reductions obtained with respect thereto.

Operating Inputs. The Operator (or the User, pursuant to Section 2.1(e)) shall, subject to the occurrence of Uncontrollable Forces, procure Operating Inputs for the Trust sufficient to operate the Facility at its Maximum Dependable Capacity. The Operator shall provide the Trust with annual projections, updated monthly, of the Operating Inputs as well as a monthly statement of all amounts due from the Trust in respect of the Operating Inputs provided by the Operator for the forthcoming month. Such monthly statements shall specify the quantity, price and type of Operating Inputs to be supplied during the coming month.

  • Operators Any and all Operators of the Equipment shall be duly experienced, trained and qualified to operate Equipment of this type. Although We may, from time to time, recommend certain qualified Operators with whom We are familiar, We do not supply Operators. You must supply and employ any Operator who operates the Equipment (even if the Operator is the owner of the Equipment or owner of a company that owns the Equipment) and that Operator shall be deemed to be Your employee and acting under Your supervision or control for all purposes and shall be covered as an insured on all of Your applicable insurance policies.

  • Operations Fire An “Operations Fire” is a fire caused by Purchaser’s Operations other than a Neg- ligent Fire. Forest Service, except as provided in B7.3, shall use cooperative deposits under B4.218 to perform fire sup- pression activities on Operations Fires. Xxxxxxxxx agrees to reimburse Forest Service for such cost for each Opera- tions Fire, subject to a maximum of the dollar amount stated in A14. The cost of Purchaser’s actions, supplies, and equipment on any such fire provided pursuant to B7.3, or otherwise at the request of Forest Service, shall be credited toward such maximum. If Purchaser’s actual cost exceeds Purchaser’s obligation stated in A14, Forest Service shall reimburse Purchaser for the excess.

  • Generating Facility The Interconnection Customer’s device for the production of electricity identified in the Interconnection Request, but shall not include the Interconnection Customer’s Interconnection Facilities.

  • ESTIMATED / SPECIFIC QUANTITY CONTRACTS Estimated quantity contracts, also referred to as indefinite delivery / indefinite quantity contracts, are expressly agreed and understood to be made for only the quantities, if any, actually ordered during the Contract term. No guarantee of any quantity is implied or given. With respect to any specific quantity stated in the contract, the Commissioner reserves the right after award to order up to 20% more or less (rounded to the next highest whole number) than the specific quantities called for in the Contract. Notwithstanding the foregoing, the Commissioner may purchase greater or lesser percentages of Contract quantities should the Commissioner and Contractor so agree. Such agreement may include an equitable price adjustment.

  • PROJECT 3.01. The Recipient declares its commitment to the objectives of the Project. To this end, the Recipient shall carry out the Project in accordance with the provisions of Article IV of the General Conditions.

  • Processing operations The personal data transferred will be subject to the following basic processing activities:

  • BUYER'S FACILITIES 1. Buyer will maintain at its own expense facilities from the delivery point to the point of use and the burners and equipment for using gas, and Buyer will at all times keep gas-using equipment on said premises in a condition conforming with such reasonable rules and regulations as may be prescribed therefore by regulatory authority having jurisdiction thereover and with the requirements of any valid law thereto appertaining. In the event that rules are not prescribed by a regulatory authority, Buyer will abide by codes as used in the gas industry.
