No Discrimination on Account of CSEA Activity. 12 Neither the District nor CSEA shall interfere with, intimidate, restrain, coerce or discriminate 13 14 against employees because of the exercise of rights to engage or not to engage in CSEA 15 16 activity. 17 18 District Rights 20 It is understood and agreed that the District retains rights to determine its organization, direct 21 the work of its employees, determine the times and hours of operation, determine the kinds and 22 levels of services to be provided and the methods and means of providing them, determine 23 staffing patterns, determine the number and kinds of personnel required, maintain the 24 efficiency of District operations, build, move or modify facilities, establish budget procedures 25 and determine budgetary allocations, determine the methods of raising revenue, contract out 26 work except as prohibited by this Agreement, and take action on any matter in the event of an 28 promote, terminate and discipline employees as provided by this Agreement and/or law. 29 The exercise of the foregoing rights, authority, duties and responsibilities by the District, the 30 adoption of policies, rules, regulations and practices in furtherance hereof, and the use of 31 judgment and discretion in connection therewith, shall be limited only by the specific and 32 express terms of this Agreement; and then only to the extent such specific and express terms 33 are in conformance with the law.
