Multiple Returns Clause Samples
The Multiple Returns clause establishes the conditions under which a party may make more than one return of goods, products, or items under a contract. Supplier shall have the capability to recognize, monitor, analyze and take corrective action on returned Product which has previously been repaired by Supplier or Supplier authorized third party(ies). Sun and Supplier shall agree on a means to measure performance in this area and report as defined in Section 4.7. For in warranty Product returned with a similar failure symptom reported by Sun or the Supplier’s testing for the third time, Sun shall have the option of requiring replacement of the defective unit at no cost to Sun.

Other than instances where “no failure” is found by Seller, if any module, card, component or item of Equipment is returned to Seller three times for Defects (whether or not the same or different Defects) within the Warranty Period, Seller shall not have the option of repairing and returning such item of Equipment to such Purchaser (as provided under Section 8.5.1) and, instead, must provide Purchaser with replacement Equipment that complies with the Specifications and take title to the returned item.
