The Internet Data Center are not intended nor provided for use in connection with, and Customer will not use them for, any nuclear, aviation, mass transit, life-support, or any other inherently dangerous applications or services, the failure of which could result in death, personal injury, catastrophic damage, or mass destruction.

Licensee agrees that MoSys shall not be liable for any claims, losses, costs or liabilities arising from such use if Licensee, its SUBSIDIARIES, or its/their distributors or customers use the LICENSED PRODUCT for such applications. Licensee agrees to indemnify and hold MoSys harmless from any claims, losses, costs, and liabilities arising out of or in connection with the use of the LICENSED PRODUCT or LICENSED INTEGRATED CIRCUITS in any such applications.

VAR agrees to notify each Sublicensee of this limitation. VAR agrees, and each Sublicensee shall agree, that Forte shall not be liable for any claims or damages arising from VAR's or a Sublicensee's use of the Products for such applications. If VAR fails to notify Sublicensee of the limitations specified above, VAR agrees to indemnify and hold Forte harmless from any claims for losses, costs, damages, or liability arising out of or in connection with the use of the Products in such applications.

Licensee agrees to indemnify and hold Artisan Components harmless from any claims, losses, costs, and liabilities arising out of or in connection with the use of the Licensed Programs or Licensed Integrated Circuits in any such applications.
