Common use of HOLIDAYS QUALIFYING FOR PREMIUM PAY Clause in Contracts

HOLIDAYS QUALIFYING FOR PREMIUM PAY. ‌ The following days qualify as a holiday for the purposes of applying the holiday premium pay provisions of this article, as noted below. No employees shall be unreasonably denied holiday leave requests to work on holidays in the following list. Holidays Qualifying for Premium Pay if Assigned and Worked: New Year’s Day* Memorial Day July 4th (Independence Day) * Labor Day Thanksgiving Day Christmas Day * The Employer shall publish an annual list of the actual dates of observance of the holidays listed above. Holiday Premium Pay Employees who are assigned to work on one of the qualifying holidays shall be paid one and one- --half times (1.5X) their regular rate of pay for all hours worked on the qualifying holidays. *Holidays marked with an asterisk shall be paid at two times (2x) their regular rate of pay for all hours worked on the qualifying holiday. The Employer may limit homemaking and social supervision hours on all holidays qualifying for premium pay as determined by the client’s needs for that day. If an employee is not assigned to work and does not work on the holiday, s/he shall not be paid the holiday premium pay. Employees who do not work on one of the qualifying holidays above shall be allowed to use any accrued leave up to eight (8) hours upon request.
