Health and Medical Claims. Importer, Importer’s employees, agents, associates and Independent Contractors are strictly prohibited from making any Health or Medical Claims about SERENIGY products; this includes but is not limited to, governmental agencies and officials, their agents, associates, workers, customs agents, etc. Making Health and/or Medical claims are strictly prohibited. Due to the extreme detrimental business consequences of making Medical and Health claims in Curacao, SERENIGY must request that by signing this addendum, the Importer has agreed to instruct and/or inform its employees, agents, Independent Contractors not to make any such claims. Any breach of this specific clause would be considered a material breach of the terms of the Agreement and subsequent termination of said business relationship. SereniGy will also seek immediate injunctive relief, damages and any other remedies available at law. SereniGy shall provide monthly sales reports of amounts of products sold and VAT payable to government authorities MINUS the amount of VAT paid on import during custom clearance process. Importer shall inform SereniGy 15 days in advance when such VAT is due so wire transfers can occur. In addition, on a monthly basis SereniGy shall provide Importer with an Invoice for Management Service Fees* for income tax purposes, which ensures profits remaining from sales are equal to the amount of Importer Fees due and owing. Importer shall NOT owe any funds to SereniGy since SereniGy will have collected all sales funds from customers directly in USA. * Management Service Fees is the amount to be invoiced in a lump sum (calculated per unit) for the offshore services of marketing commissions, loans for customs duties and prepaid IVA, local delivery, etc., provided by SereniGy to importer.   • Hospital and Medical Insurance The University shall make available health insurance to the employees covered by this agreement to the same extent and in the same manner as is available to other University employees, such as Faculty and the Executive, Administrative and Professional Staff employees. It is the University's goal to have the same health insurance plans offered uniformly to all University groups and employees.

  • Family Care and Medical Leave An unpaid Family Care and Medical Leave shall be granted, to the extent of and subject to the restrictions as set forth below, to an employee who has been employed for at least twelve (12) months and who has served for one hundred thirty days (130) workdays during the twelve (12) months immediately preceding the effective date of the leave. For purposes of this section, furlough days and days worked during off-basis time shall count as "workdays". Family Care and Medical Leave absences of twenty (20) consecutive working days or less can be granted by the immediate administrator or designee. Leaves of twenty (20) or more consecutive working days can be granted only by submission of a formal leave application to the Classified Personnel Assignments Branch.

  • Department of Health and Human Services An employee notified of a positive controlled substance or alcohol test result may request an independent test of their split sample at the employee’s expense. If the test result is negative, the Employer will reimburse the employee for the cost of the split sample test. An employee who has a positive alcohol test and/or a positive controlled substance test may be subject to disciplinary action, up to and including dismissal, based on the incident that prompted the testing, including a violation of the drug and alcohol free work place rules.

  • Health Care Operations Health Care Operations shall have the meaning set out in its definition at 45 C.F.R. § 164.501, as such provision is currently drafted and as it is subsequently updated, amended or revised.

  • Medical Care The Parents must comply with the School Welfare Officer's recommendations which may include a reasonable decision to release the Pupil home or to his / her education guardian when s/he is unwell.

  • Medical Care Leave An Employee who is unable to make the necessary arrangements for maintenance of personal health care outside of scheduled work time, shall be granted time off with pay. Such time off shall not exceed sixteen (16) working hours per calendar year. Hours in excess of sixteen (16) hours per calendar year shall be deducted from the Employee's sick leave accumulation.
