Death of the Holder. Subject to Applicable Tax Legislation, where there is a Survivor and the Holder has validly designated the Survivor as successor holder, the Survivor shall become the Holder. In the event of the death of the Holder where there is no Survivor or the Survivor has not been designated as a successor holder, the Trustee shall, upon receipt of satisfactory evidence thereof, realize the interest of the Holder in the Account. Subject to Applicable Tax Legislation and to the deduction of all proper charges, including taxes, if any, required to be withheld, the proceeds of such realization shall be paid by the Trustee, as the case may be, to the estate of the Holder or to the Holder’s designated beneficiary upon furnishing the Trustee with such releases and other documents as may be required or as counsel may advise. If more than one designation has been lodged, the Trustee shall rely on the instrument in its possession bearing the latest execution date.

Death of the Holder. In the event of the death of the Holder where the Holder has validly designated the Successor Holder (and the Holder is domiciled in a jurisdiction designated by the Trustee as one in which a holder of a tax-free savings account may validly designate a successor holder), the Successor Holder shall become the Holder. In the event of the death of the Holder where there is no Successor Holder or the Successor Holder has not been designated, the Trustee shall, upon receipt of satisfactory evidence thereof, realize the interest of the Holder in the Account. Death of the Holder. At and after the death of the Holder and upon receipt of satisfactory evidence of his/her death, if the Survivor acquires all of the Holder’s rights under this Arrangement and an unconditional right to revoke any beneficiary designation, the Survivor shall become the Holder of the Arrangement. Subject to any applicable legislation, if the Survivor does not acquire all of the Holder’s rights under this Arrangement and an unconditional right to revoke any beneficiary designation, upon receipt of satisfactory evidence of the death of the Holder, the Issuer shall hold the assets of the Arrangement for payment in a lump sum and the payment shall be made to the legal representatives of the Holder. The payment shall be made subject to deduction of all the appropriate fees, including the withholding tax, after the Issuer has received the waivers and the other documents that it requests, at its sole discretion. The Account shall cease to be registered as a TFSA under the Act immediately before the death of the last Holder of the Arrangement. If the Holder wants his/her Spouse to become the Holder of the Arrangement upon his/her death, as provided in the Act, the Holder should consult his/her legal counsel to take the appropriate actions.
Death of the Holder. The deceased owner's inheritors, legatees or executors: o May neither draw nor operate with the cash, deposits or securities while: (I) they do not prove their right to succeed the deceased holder and (II) they have not complied with the pertinent tax obligations. o They must provide Bankia with the necessary documentation to make changes regarding the ownership of the deceased holder's products. Bankia will provide the necessary services for the distribution of the succession dossier. The deceased holder's heirs are obliged to notify Bankia of the holder’s death as soon as possible. Upon the death of the holder, any authorisation granted during his/her lifetime will be cancelled, wherefore the authorisation granted to the Authorised Parties shall be terminated upon the account holder's death. - Death of one of the holders in the event of Joint Holders: o The surviving joint holder who wishes to carry out transactions with the product must certify that he/she is the holder of the portion of the balance regarding which he/she wishes to operate. o If it is not accredited, it will be understood that ownership of the balance of the product corresponds in equal parts to all the holders (including the deceased). In this way, each of the holders will not be individually entitled to draw or operate on a part of the Balance that is greater than the proportional part to which they are entitled.

  • Death of Grantee If the Grantee shall die during the term of this Option, the Grantee's legal representative or representatives, or the person or persons entitled to do so under the Grantee's last will and testament or under applicable intestate laws, shall have the right to exercise this Option, but only for the number of shares as to which the Grantee was entitled to exercise this Option in accordance with Section 2 hereof on the date of his death, and such right shall expire and this Option shall terminate one (1) year after the date of the Grantee's death or on the expiration date of this Option, whichever date is sooner.
