CONTRACT DOCUMENTS AND AGREEMENT. 2.13.1 The order placed under this specification shall be governed by the terms and conditions as incorporated in this section of the specification and as given in the purchase order and its annexure(s). The terms and conditions as specified in this section, if differ from the terms as indicated in the purchase order and its annexures, the later shall prevail. The contract shall for all purposes be constructed according to the law of India and subject to jurisdiction of procuring entity Jaipur court only. For the due fulfillment of the contract, the supplier shall execute an agreement in the prescribed form on non-judicial stamp paper of Govt. of Rajasthan worth Rs. 5000/- or as per the stamp duty made applicable by Government of Rajasthan at time of signing of contract agreement. Such agreement shall be executed and signed by the competent authority of the supplier on each page thereof. The original copy is only to be executed on the stamp paper. Such complete agreement form along with the contract documents shall be required to be returned to the Purchaser within a period of 15 days from the receipt of the order duly signed on each page. One copy of the executed agreement duly signed by the Purchaser shall be sent to the supplier for his reference. The contract documents shall mean and include the following;

  • Construction Contract Documents The Construction Contract Documents shall consist of the plans and specifications prepared by the Engineer, and any addenda and change orders thereto, and the Owner-Contractor Agreement, all of which shall be compatible and consistent with this Agreement.

  • Construction Documents The architectural and engineering documents setting forth the design for the Project prepared by the Design Professional. Construction Documents include, but are not limited to, the Specifications, the Drawings, the Supplementary Conditions, the General Conditions, and all Addenda.

  • INTENT OF CONTRACT DOCUMENTS 1.1 It is the intent of the Contract Documents to describe a functionally complete Project (or portion thereof) to be constructed in accordance with the Contract Documents. Any work, materials or equipment that may reasonably be inferred from the Contract Documents as being required to produce the intended result shall be supplied whether or not specifically called for. When words which have a well-known technical or trade meaning are used to describe work, materials or equipment, such words shall be interpreted in accordance with that meaning. Reference to standard specifications, manuals or codes of any technical society, organization or association or to the laws or regulations of any governmental authority having jurisdiction over the Project, whether such reference be specific or by implication, shall mean the latest standard specification, manual, code, law or regulation in effect at the time the Work is performed, except as may be otherwise specifically stated herein.

  • Copies of Contract Documents to Contractor Without charge to the Contractor the Design Professional shall furnish to the Contractor up to five sets of completed Contract Documents in hardcopy, one set of reproducible and electronic background floor and reflected ceiling plan drawings and, if requested, one copy in read-only electronic format. The Contractor may obtain such additional sets of Contract Documents, as the Contractor deems necessary and shall pay the cost of reproduction of such additional sets to the Design Professional.

  • Contractor’s Documents Any licensing and maintenance agreement, or any order-specific agreement or document, including any pre-installation, linked or “click through” agreement that is allowed by, referenced within or incorporated within the Contract whenever the Contract is used for a State procurement, whether directly by the Contractor or through a Contractor’s agent, subcontractor or reseller, is agreed to only to the extent the terms within any such agreement or document do not conflict with the Contract or applicable Minnesota or Federal law, and only to the extent that the terms do not modify, diminish or derogate the terms of the Contract or create an additional financial obligation to the State. Any such agreement or document must not be construed to deprive the State of its sovereign immunity, or of any legal requirements, prohibitions, protections, exclusions or limitations of liability applicable to this Contract or afforded to the State by Minnesota law. A State employee’s decision to choose “accept” or an equivalent option associated with a “click- through” agreement does not constitute the State’s concurrence or acceptance of terms, if such terms are in conflict with this section.   • Contract Document This Contract is composed of Sections 1 through 9, Exhibits A through F, Attachments 1 through and any exhibits referenced in said attachments, and any documents incorporated by reference, which contain all the terms and conditions agreed upon by the parties.
