Compliance With Clean Air And Water Acts. This Agreement is subject to 42 U.S.C. 1857, et seq., and 33 U.S.C. 1251 et seq., and the regulations issued pursuant thereto. Therefore, GRANTEE agrees as follows:
Compliance With Clean Air And Water Acts. In compliance with the Clean Air Act, as amended, 42 U.S.C. 1857 (R) et. seq., Section 508 of Clean Water Pollution Control Act, as amended 33 U.S.C. 1368 and Executive Order 11738,1251 et. seq., and the regulations of the Environmental Protection Agency with respect thereto, the appropriate parts of 40 CFR as amended from time to time, Contractor agrees that:
Compliance With Clean Air And Water Acts. The Contractor shall adhere to the provisions which require compliance with all applicable standards, orders, or requirements issued under Section 306 of the Clean Air Act and Section 508 of the Clean Water Act, which prohibits the use under non-exempt Federal contracts, grants or loans of facilities included in the EPA List of Violating Facilities.
Compliance With Clean Air And Water Acts. (applicable to all contracts over $100,000): In carrying out this agreement, the contractor agrees to comply with the requirements of Section 306 of the Federal Clean Air Act (42 USC 1857(h)), section 508 of the Clear Water Act (33 USC 1368), Executive Order 11738, and the Environmental Protection Agency regulations (40 CFR Part 15) respective to all contracts in excess of $100,000 awarded by grantees and subgrantees. Such statutes and regulations prohibit the use under non-exempt Federal contracts, grants or loans of facilities included on the Environmental Protection Agency’s List of Violating Facilities. The provision shall require reporting of violations to the grantor agency and to the US Environmental Protection Agency.

In compliance herewith, the Contractor agrees that: No facility to be utilized in the project or program is on the list of Violating Facilities issued by the U.S. Environmental Protection Agency (EPA) pursuant to 40 CFR §15.20. The Contractor will comply with all applicable standards, orders or regulations issued pursuant to the Clean Air Act, as amended, (42 U.S.C. §7401-7671q) the Federal Water Pollution Control Act, as amended (33 U.S.C. §1251-1387). As a condition for the award of this Agreement, the Contractor shall give prompt notice to the City of any notification of violations received from the Office of Federal Activities or the EPA, indicating that a facility utilized or to be utilized is under consideration to be listed on the EPA List of Violating Facilities. The Contractor will include or cause to be included the requirements contained in paragraphs A through C of this clause in every lower-tier nonexempt contract and will take such action as the City may direct as a means of enforcing such provisions.

Tenant shall cause all of its waste to be regularly removed from the Premises at Tenant’s sole cost. Tenant shall keep all fire corridors and mechanical equipment rooms in the Premises free and clear of all obstructions at all times.

  • Environmental Pollution Unless disposition of environmental pollution is specifically a part of this contract, PURCHASER shall immediately notify STATE of any hazardous substance(s) which PURCHASER discovers or encounters during performance of the operation. "Hazardous substance(s)" are those substances, materials, or wastes regulated by state or federal law. PURCHASER shall immediately cease operating in any particular area of the operations where a hazardous substance(s) has been discovered or encountered, if continued operations in such area would present a bona fide risk or danger to the health or well being of PURCHASER's or any subcontractor's work force. Upon being notified by PURCHASER of the presence of hazardous substance(s) on the areas of operations, STATE shall arrange for the proper disposition of such hazardous substance(s).
