Assessment of POR Performance. In order to assess the quality of delivery of POR when required by the Power System, the Providing Unit will be monitored and assessed during an Event by the Company. The assessment of POR performance is carried out at the time of the Nadir Frequency during the POR time range of T+5 seconds to T+15 seconds (the “POR Period”). The value of the POR Performance Scalar will be determined based on whether the result of the Performance Assessment is a Pass or Fail.

Assessment of POR Performance. In order to assess the quality of delivery of POR when required by the power system, the Generating Unit will be monitored and assessed during a Frequency Event in accordance with the provisions of this Section 3 and the provisions of OC11.5.5 of the Grid Code (Spinning Reserve Monitoring) shall not apply to this Agreement. The assessment of POR performance is carried out at one point in time corresponding to the time of the Nadir Frequency during the POR time range of T+5 seconds to T+15 seconds (the “POR Period”). Charges will be applied based on the extent of the difference between the Expected POR and the Achieved POR for the Generating Unit. The basis for calculating the Expected POR is the anticipated Generating Unit response to the Frequency reduction. The increase in the Generating Unit Output is driven by the governor response and is limited by the sustained loading ability of the Generating Unit. In the initial phase of the POR Period it is recognised that the Generating Unit Output may lag behind the theoretical droop determined response due to the physical reaction of the unit to a power system Frequency change, the variation depending on generating unit type. To compensate for this, the assessment uses the POR Governor Droop Multiplier which decays to a value of one over time, the value during the POR Period determined from the POR Governor Droop Multiplier Alpha and the POR Governor Droop Multiplier Beta. If the Achieved POR response is less than the Expected POR response after the application of the Applicable Tolerance a POR failure is recorded. Where a Frequency Event has occurred while the Generating Unit was Synchronised to the power system, the Generating Unit response to any further Frequency Event occurring within 5 minutes after the end of the Frequency Event will not be taken into account for settlement purposes.

  • Assessment of Performance The assignment of a teacher to a TLS position will be subject to review by the school district’s administration at least annually. The first review must be completed no later than five (5) work days before the beginning of the transfer process. The review shall include peer feedback on the effectiveness of the teacher’s performance of duty specific to the teacher’s TLS position. A teacher who completes an assignment in a TLS position may apply for assignment to a new TLS position.

  • Criteria for Performance Assessment A. A teacher’s performance shall be assessed based on the standards for the teaching profession and the criteria set forth in the evaluation instrument, Appendix E to this agreement.

  • Consideration for Performance The consideration to be paid to the Contractor under this Agreement will be compensation for all the Contractor’s expenses incurred in the performance of this Agreement, unless otherwise expressly provided.

  • Time for Performance 1.1. The term of this SOW Agreement shall begin on and end on (the “Initial Term”). The Initial Term may be extended as the parties may agree. The State may terminate this SOW for convenience upon thirty days prior written notice to the Contractor. If the Master Agreement should expire or otherwise terminate prior to the end of the term of this SOW Agreement, this SOW Agreement shall continue to the end of its existing term, unless or until terminated in accordance with the terms of this SOW Agreement, and the Parties acknowledge and agree that the terms of the Master Agreement shall survive and apply to this SOW Agreement.

  • Security for Performance In the event that Exhibit A Section 4 indicates the need for Consultant to provide additional security for performance of its duties under this Agreement, Consultant shall provide such additional security prior to commencement of its Required Services in the form and on the terms prescribed on Exhibit A, or as otherwise prescribed by the City Attorney.

  • Excuse for Nonperformance or Delayed Performance Except with respect to defaults of subcontractors, Contractor/Vendor shall not be in default by reason of any failure in performance of this contract in accordance with its terms (including any failure by Contractor/Vendor to make progress in the prosecution of the work hereunder which endangers such performance) if Contractor/Vendor has notified the Commission or designee within 15 days after the cause of the delay and the failure arises out of causes such as: acts of God; acts of the public enemy; acts of the State and any other governmental entity in its sovereign or contractual capacity; fires; floods; epidemics; quarantine restrictions; strikes or other labor disputes; freight embargoes; or unusually severe weather. If the failure to perform is caused by the failure of a subcontractor to perform or to make progress, and if such failure arises out of causes similar to those set forth above, Contractor/Vendor shall not be deemed to be in default, unless the services to be furnished by the subcontractor were reasonably obtainable from other sources in sufficient time to permit Contractor to meet the contract requirements. Upon request of Contractor, the Commission or designee shall ascertain the facts and extent of such failure, and, if such officer determines that any failure to perform was occasioned by any one or more of the excusable causes, and that, but for the excusable cause, Contractor’s progress and performance would have met the terms of the contract, the delivery schedule shall be revised accordingly, subject to the rights of the State under the clause entitled (in fixed-price contracts, “Termination for Convenience,” in cost-reimbursement contracts, “Termination”). (As used in this Paragraph of this clause, the term “subcontractor” means subcontractor at any tier).

  • COMPLIANCE AND PERFORMANCE EVALUATION Two (2) Mandatory Compliance and Performance Evaluation Meetings shall be conducted during each Term of this Agreement. Additional meetings may be scheduled at the discretion of Department to ensure Concessionaire’s effectiveness and compliance. The meetings shall review all aspects of the Concession Operation, ensuring that quality public services are being provided on a continuing basis in accordance with the Bid Specifications and this Agreement, that operational problems/concerns are addressed on a timely basis, and that all terms and conditions are clearly understood. The meetings shall be held on site with Department-designated State Park Service staff representative(s), the on-site concession manager, and a management/supervisory representative of Concessionaire’s firm. A report form shall be utilized to document the meeting, and to identify any deficiencies and the corrective action required. A copy of the completed report form shall be provided to the on- site concession manager or the management/supervisory representative of Concessionaire’s firm and shall be attached to and made a part of this Agreement. The Mandatory Compliance and Performance Evaluation Meetings shall be held as follows: • Meeting #1 - Prior to commencement of the Period of Operation or Memorial Day, whichever comes first. • Meeting #2 - Within ten (10) calendar days after the last approved day of the Period of Operation.
