Applicable Laws and Courts. This resulting contract shall be governed in all respects by the laws of the Commonwealth of Virginia and any litigation with respect thereto shall be brought in the courts of the Commonwealth. The agency and the Purchaser are encouraged to resolve any issues in controversy arising from the award of the contract or any contractual dispute using Alternative Dispute Resolution (ADR) procedures (Code of Virginia, § 2.2-4366). MCI will provide the services proposed pursuant to its applicable tariffs which are incorporated herein by reference and made a part hereof. In the event on any pricing proposed pursuant to RFP # DOC-05-005 requires a tariff filing, such pricing shall not be effective until the appropriate FCC or SCC approval has been obtained.
