Common use of Accumulation of Leave Clause in Contracts

Accumulation of Leave. Annual leave is cumulative; however, it is agreed that when an employee accrues an excessive amount of leave the Employer may compel the employee to take apportion of their leave. For the purposes of this clause, excessive leave accumulation is that of two months or more. In the event that an employee has excessive leave the Employer may compel the employee to take two weeks of their accumulation. If the Employer intends to compel an employee to take leave the Employer will provide that employee with a minimum of four weeks written notice. Nothing in this clause prevents the Employer and an employee from agreeing to a greater accumulation of annual leave.
