Arbitrationwith Foreign Suppliers Arbitration with foreign suppliers shall be conducted in accordance with the arbitration rules of the United Nations Commission on International Trade Law (UNCITRAL); or with proceedings administered by the International Chamber of Commerce (ICC) and conducted under the ICC Rules of Arbitration; by one or more arbitrators appointed in accordance with said arbitration rules.
Any dispute arising between the Parties out of or in connection with the interpretation and execution and/or termination of the contract of sale ruled by these GTCS and/or out of and/or in connection with the interpretation of these GTCS shall be submitted to the decision of a board of arbitration consisting of three arbitrators appointed according to the Rules of Arbitration of the International Chamber of Commerce in Paris, that the Parties declare to know and accept.
The arbitral tribunal constituted under the Rules of Arbitration shall apply this Contract, the Convention and, to the extent that issues in dispute are not covered by this Contract or the Convention, the arbitral tribunal shall apply general principles of law.
Specifically, the arbitration provision required that the LCIA Expert Determination process be used to resolve “any disputes related with [the Contract] which exclusively arise out of technical or administrative issues” including, but not limited to, “whether a delay in Work is attributable to an Act of God or Force Majeure.” All other disputes arising out of the contract were to be resolved under the LCIA Rules of Arbitration.
Any dispute between the Guarantee Holder and MIGA arising out of or in connection with this Contract shall be settled by final and binding arbitration in accordance with the Rules of Arbitration.
